INTERNATIONAL SCENARIO– In different parts of the world such as United States does not have hate speech since according to them it would violate the guarantee to freedom of speech contained in First Amendment of the Constitution. In Canada, the offence is indictable, and carries a maximum penalty of imprisonment not exceeding five years. In Germany, for any hate speech to be punishable, the law requires that said speech be “qualified for disturbing public peace” either by inciting “hatred against parts of the populace” or calling for “acts of violence or despotism against them” or by attacking “the human dignity of others”. There are other countries where there are laws related to hate speeches around the world such as in Saudi Arabia, Qatar, Bahrain, France, Nigeria, South Africa etc. These countries are also facing the problems related to hate speeches and crimes but trying their best to maintain social harmony and brotherhood in the society.
CONCLUSION AND SUGGESTION– So, the overall conclusion that can be drawn from the above points is that The Central as well as The State Governments needs to address the issues related to misuse of SECTION 295-A and the OTTS which are playing with the sentiments among all the communities of the society so that they can become famous, increase their viewership and many other benefits. Further, the social media and TV are causing more harm than the benefit and hence people are getting diverted, aggressive, agitated and jealous resulting in religious riots, mental frustration and the brotherhood among the various communities gets hampered because of the hate speeches and the comments which are made in the name of religion, to gain sympathy and most of the politicians, bollywood actors are mostly spreading Islamophobia, Hindu Phobia, saying rubbish about the gods and goddesses of Hindu, Sikh, Muslims and Christian faiths and portraying their negative image which would hurt the sentiments of millions. ARTICLE 19 of the Constitution of India states about freedom of speech and expression and ARTICLE 21 of the Constitution of India guarantees Right to Personal Liberty but these rights often comes with certain duties and hence we as the common citizens should be bound with the duty not to believe the rumors and fake news that are being generating around us just to cause disharmony and disruption insociety and the government should take strict actions against the offenders.
