A RECENT DEVELOPMENT IN THE SYSTEM OF IPR

In the recent times, India has been trying to establish itself as an Intellectual Property Rights (IPR) friendly nation in the world, by defining its standards as per the Global Intellectual Property norms. This has been clearly reflected in some of the latest developments in the laws related to Intellectual Property Rights in India.

One such effort can be seen in the Indian government’s vision to set-up fully computerised Intellectual Property offices based on the United States Patent and Trademark Office model. This recent development was said by the government in an official Rajya Sabha meeting. The government is trying to set up a fully computerized Intellectual property rights (IPR) office in the country which is similar to the US model where everything is done online.

They are in the process of computerising every process so that people don’t have to go to any IPR office whatsoever which makes it very easy for the people. In the whole of the US, there is one IPR office and everybody works online. This is the example that the Indian government wishes to opt. With smartphones proliferating all over India, the government wants to ensure rural artisans and craftsmen engage directly online through video conferencing and get advise on patent related issues free of cost.

The benefits of this include first action pendency period, stability of the patent, level of computerisation, ease in using IP databases, transparency of procedures, user-friendliness in accessing status of applications and the like. Modernisation, especially computerisation will help IPR Offices in addressing the challenges on a day to day bases as they won’t have the visit the office centres daily.

This will be very beneficial to the start-ups, artisans, farmers, craftsmen, people living in traditional areas and women entrepreneurs. The government is very committed that rural India is engaged with the world when it comes to the country’s traditional knowledge and culture
Experts say that the idea is to spread awareness, as more and more people become aware, it serves our purpose. We simultaneously try to promote and encourage people to take up programs on their own and involve larger communities.

The basic idea of the new IPR policy is to provide an ecosystem which encourages individuals and corporate entities to take risk by putting in their efforts, money, labour so that they also derive reasonable benefits out of their own efforts. But the underlined larger focus still is that all this has to benefit to the society as a whole and India in particular.
