Artificial Intelligence i.e. AI is the simulation of human intelligence processes by machines, especially computer systems. It aims at fastening the process of analysing and arriving at solutions. According to national judicial data grid (NJDG) more than 3.89 crore cases are pending at district and taluka level itself. More than 50 thousand cases are pending at High court level.
Artificial intelligence and its use will help in increasing the efficiency of judiciary and will lessen the burden of pendency. Already eCourts portal has been providing data on cases in courts. Apart from this, two projects like SUVAS, a translation tool and SUPAS, and administration tool used in supreme court are in use.
This shows that use of artificial intelligence is not a far fetched dream, it is already in the process of adaptation according to needs of the judiciary. It can help expedite the research work required to solve cases, retreive essential cases and articles, and other human like work. This will augment decision making process.
But there is also no doubt that as AI technology grows, concerns about data protection, privacy, human rights and ethics will pose fresh challenges and will require great self-regulation by developers of these technologies. AI should be used only to the extent to assist judges, lawyers and litigants in making judiciary efficient and accessible but how, when and what to decide would be left to the judges.
AI could be deployed in India in a phase-wise manner through generational innovation. The first generation of AI pilots can be oriented towards increasing administrative efficiency, the learnings of which can feed into the second generation of tools which can target decision making processes.
Introducing feedback loops and impact evaluation frameworks can help technology evolve and inform the broader discourse on governance on AI. The second generation of AI tools can target decision making processes by inducting more sophisticated AI technologies like case query tools, intelligent analytics, research augmentation, computational tools directly aiding in judicial decisions, and legal robotics.
In this way, artificial intelligence will not encroach the expertise of human mind which is not right to let it become irreplaceable at the moment. AI will only help as a supportive asset in increasing efficacy of Indian Judiciary.
