all about adoption

WHAT IS ADOPTION ?

Section 5 of The Hindu Adoption Act,1956 defines adoption.

Adoption is a legal prosse4s in which  there is a fully transfer of parental responsibility of a child gorm his parents or guardian to their adoptive parents. There are lots of children who lives in orphanage  and roadside and had no one to take care of them or to love them. These children are mostly adopted by the people who seek to love them and thus these children are provided with a good life style. The adopted child have given lots of health care facilities, education etc. by their adopted parents.

TYPES OF ADOPTION

  • FOSTER CARE – This is the temporary custody or guardianship of a child whose parents are not alive or are incapable to look after their child.
  • FOSTER-TO-ADOPT – In this the child is place in an approved home, with the expectation that the child will become legally free and be adopted by them.
  • INFANT ADOPTION – In this  a child is adopted when the baby is 24hrs old to 3 days old.  The people who wants to adopt a child went to lawyer, physician rather than licensed adoption agency.
  • INDEPENDENT ADOPTION – In this the  birth parents select the adoptive parents and place the child in their custody.

ELIGIBILTY OF ADOPTION

  • The adoptive parents must be physically, mentally, emotionally, financially stable.
  • If the person is married, then the consent of both the spouse is essential for adoption.
  • A single female is eligible to adopt a child of any gender.
  • A single male is not eligible to adopt a girl child.
  • The minimum age difference between the child and adoptive parents must be of 21 years.
  • Couple with 3 or more than 3children can not adopt  a child.
  •  To adopt a child , the adoptive parents age must be 21 years. The age perspective to adopt the child are –

RIGHTS  OF THE ADOPTED CHILD

Adopted  child would have same right as biological child. The adopted child can claim on their adoptive parent’s property and the adoptive parents can also claim the right on adopted child’s property.

DUTIES OF ADOPTION AGENCY

  • To provide a child with proper education, heal facilities, psychological needs, emotional needs etc.
  • To provide training likes leisure and recreational activities.
  • To protect the child from abuse, exploitation, neglect.
  • The report of orphanages of children is submitted to Adoption Resources information.

WHO CAN  GIVE A CHILD FOR ADOPTION

Section 9 of The Hindu Adoption And Maintenance Act says that only the father or the mother or the guardian of the child have the capacity to give the child for adoption

CONCLUSION

Adoption rate in India is increasing . The adoption process is the biggest development process. A child gets his family and had a new beginning. They are loved, cared, pampered, cuddled. They get proper education and all the facilities. Adoption allows a single parent to share their life with a child and enjoy the unique experience of parenthood .Every child has a right to have a loving family for their overall development.
