Vishakha vs. State of Rajasthan, the case in which guidelines by Supreme Court related to the prevention of sexual harassment of women at workplace, as earlier the women has to tackle their home and children, and men has to earn the daily bread but as society change and develop, the concept of equality and equity came into picture as women stands for the same opportunity which man wants to seek. But the question here is whether the men and LGBTQ Committee comes under the umbrella of POSH Act or this act is only protection women? What if Man or LGBTQ is bullied or sexually harassed?
The act focuses to provide the safe environment to women at workplace and it is the basic human right, but man and LGBTQ are also humans. Sec 2(a) of the act only covers the aggrieved women to take relief, if referring to IPC it is being noted that most of the laws are divert in the favour of women and there is no such law which favours a man because law teach us what is equality and law does not itself look equal toward men and women.
Since the law amendment takes years to be amended, but one cannot suffer because of lacuna in the law, the possible solution to the problem can be the separate guidelines regarding the non-female worker, if they become the victim of sexual harassment or sexual assault which will be count under the disciplinary action towards the one and not in the ambit of POSH law.
