Gaurang Kanth, an Indian lawyer located in New Delhi, was born on August 20, 1975. In 1998, he was admitted to the Delhi Bar Council as an Advocate. Since October 2016, he has been a member of the Central Government Standing Counsel.
He obtained his Bachelor’s in History from the Hindu College, the University of Delhi in 1995 and afterwards, went on to finish his Bachelors in Law from the same University in 1998. After being admitted to the Bar in 1998, he pursued his Master of Laws in American and Comparative Law, with a specialization in Intellectual Property Law from the University of Denver, College of Law, the U.S.A. in 2001. Kanth also worked as an attorney at O’Connell and Zuffoletto, LLP in San Diego, California, from May 2002 to March 2005, after completing his master’s in Law. Kanth came to India in 2005 after a successful legal career in the United States and founded Kanth & Associates, a full-service international law practice situated in Nizamuddin, New Delhi. He has extensive experience as a litigator, having appeared in several courts and representing a wide range of clients in a variety of situations. He focuses in Civil and Criminal Litigation, as well as Alternative Dispute Resolution.
He has advised and appeared for the Central Government along with numerous private entities in matters involving interpretation of the Constitution, corporate and commercial laws, banning of terrorist and disruptive organizations, competition laws, money laundering, anti-doping laws, international commercial arbitrations and public international laws etc. To date, he has handled more than 4,000 cases across the Supreme Court of India, various High Courts, Trial Courts and special Tribunals.
He has filed various petitions over the years for the larger interests of the public. A notable matter namely, Gaurang Kanth vs Archaeological Survey of India[2], was filed before the Delhi High Court against the undertaking any construction within the prohibited area of 100 meters around the Humayun’s tomb in Delhi, which is a World Heritage Site as recognized by the United Nations Educational, Scientific and Cultural Organization (UNESCO). This case was instrumental in bringing about an amendment in the Ancient Monuments and Archaeological Sites and Remains Act, 1958, making it a more robust protector of ancient and medieval archaeological monuments and sites in the country.
He also filed a petition namely Ved Prakash & Anr Vs Union of India challenging the acquisition of Cadbury India by Kraft Foods amounting to 19 Billion USD (approx.). The petition filed by him before the Delhi High Court along with a social activist Ved Prakash said that Cadbury had evaded substantial tax liability in India, which eventually led to a government probe into the deal.
One of his notable petitions included the case of a 17-year-old boy who was denied admission to St Stephen’s College, Delhi because the minimum age requirement for enrolment was 18 years. His petition Kshitiz Kumar Mallick Vs Directorate of Education led Delhi University to do away with the age requirement of students for enrolment.[5] Gaurang Kanth has been involved in a slew of high-profile cases in addition to PILs. He argued before the Delhi High Court and the Hon’ble Supreme Court of India that the CAG could audit private telecom businesses in Cellular Operator Association vs. Department of Telecommunication and Association of United Telecom Services vs Union of India.
He’s also supporting the Central Adoption Resource Agency (CARA) in effectively implementing the orphan adoption legislation As the Standing Counsel; I have represented municipal authorities in Delhi and defended the interests of such agencies like the Comptroller and Auditor General of India (CAG) and the Central Information Commission (CIC). This has resulted in a significant improvement in civic life and the administration of the government’s extended arms.
Gaurang Kanth has also testified on behalf of the National Anti-Doping Agency (NADA) in a number of cases. He was a key contributor to the 2015 NADA Anti-Doping Rules. He successfully backed NADA’s decision to ban the athlete in Amar Murlidharan vs. NADA, India’s first-ever appeal to the Centre of Arbitration on Sports (CAS). He also successfully defended NADA after wrestler Narsingh Yadav was suspended for four years. He recently wrote to the Chief Justice of the Delhi High Court, requesting that the organisers and attendees of the Tabligh-e-Jamaat Markaz, as well as the administrators responsible for the Nizamuddin gathering, be held accountable for the spread of COVID-19. Apart from the above, he has authored various accredited and widely published articles on legal and policy issues including RBI’s timely and decisive response to safeguard the Indian economy from coronavirus impact; Union budget 2020: the government has taken bold steps to put the economy back on track; Ayushman Bharat: Why Rob Delhi Of a World-Class Health Scheme?; Water Scarcity: With ‘Jal Jeevan Mission’, Government Tends to Focus on Behavioural Change; The Consumer Protection Act, 2019: an overview; Juvenile Justice Act, 2015- Rationalising Inter-Country Adoptions; Concurrent Power: Whether a Tool for Political Gains?; Emergence of Sports Law in India among many others.
Gaurang Kanth is also frequently invited on national television including Times Now, India Today, News X, Rajya Sabha TV, CNBC, conferences, seminars, and workshops on current legal and political issues. Commending his impact in the legal field, he was featured as one of the best young lawyers in the country by The Week.
