Life
Prathiba Maninder Singh (born July 20, 1968) is an Indian judge who currently serves on the Delhi High Court. As a practising lawyer and an advisor to many legislative committees developing related laws, she has made major contributions to scholarly research and legal advancements in Indian intellectual property law.
Study
Justice Prathiba M. Singh earned her law degree from University Law College in Bangalore after completing a five-year programme. She graduated from Bangalore University with a first-place finish and went on to represent India at the Philip C Jessup Moot Court competition in Chicago, USA. The Cambridge Commonwealth Trust offered her the ODASSS scholarship to study LL.M at the University of Cambridge (U.K.).
Career
Singh was admitted to the bar in 1991 and worked as a managing partner in a legal company, especially in the subject of intellectual property law. The Delhi High Court appointed her to advise them on how to enhance the running of the Copyright Office, and she also advised a High Level Parliamentary Panel on how to streamline the patent examination process in India. She’s also given expert testimony to parliamentary committees on proposed changes to India’s intellectual property laws, such as the Patents Act and the Copyright Amendment Act of 2012. In 2014, Singh was also a member of a team that drafted India’s National Intellectual Rights Policy.
She was a top Intellectual Property lawyer in India before being elevated to the Bench. She had the honour of managing major cases in every area of intellectual property law, including patents, trademarks, designs, copyright, plant varieties, internet regulations, and so on. She counselled clients and handled cases including commercial disputes, arbitration, telecom, broadcasting laws, media laws, writs, regulatory issues, education, and more as the Managing Partner of Singh & Singh. She has appeared before the Supreme Court of India, the High Court of Delhi, the TDSAT, the IPAB, and the Trademark and Patent Offices on a regular basis. The High Court of Delhi designated her as an Amicus Curiae to help the Copyright Office work more efficiently. She was also named to a High-Level Committee to Simplify Patent Examinations.
In the case Novartis v. Union of India & Others, Singh represented Cipla against Novartis in 2013, establishing Cipla’s right to produce generic versions of Novartis’ proprietary cancer medicine. The case has received a lot of attention and is significant in Indian intellectual property law. In 2016, Singh represented the petitioners in a case against WhatsApp, in which the Delhi High Court ordered WhatsApp to delete user information from people who had cancelled their accounts in anticipation of revisions to WhatsApp’s privacy policy.
She was asked to speak as an expert before Parliamentary Committees examining modifications to the Patents Act of 2002, the Copyright Amendment Act of 2012, the Geographical Indications Act, and other legislation.
In 2013, the University of Cambridge established the Prathiba M. Singh Scholarship for LL.M. students. Scholarships are awarded to Indian students who have been accepted into the LLM programme at Cambridge.
She was a member of the IPR Think Tank, which was tasked with creating India’s first ‘National IPR Policy,’ which was published in May of 2015.
‘India – Beyond the Headlines,’ ‘India is a Game-Changer in Patent Laws,’ ‘Implementation of the Commercial Courts Act,’ ‘CRI recommendations,’ ‘Expedited trials in patent matters,’ and other pieces have appeared in important international and national journals.
Several significant initiatives were undertaken during her tenure as President of the APAA (Indian Group), including the filing of a writ petition demanding the establishment of the IPAB and the construction of the IPAB’s Delhi court-room complex. She has spoken at many national and international IP-related workshops, seminars, and events on a regular basis. She also served on the CII’s IPR National Steering Committee.
Managing IP’s ‘Asia Women in Business Law Honors’ for achievement in Litigation, Legal Era’s ‘IP Lawyer of the Year, 2013’, Legal Era’s ‘Best IP Senior Counsel of the Year – 2014’, and the Indian National Bar Association’s ‘Woman Lawyer of the Year, 2015’ are among the awards she has received.
She was a member of the SCBA, DHCBA, INTA, APAA, AIPPI, IPAA, IPLPA, and Telecom Lawyers Association, among others.
Prathiba Singh was appointed Senior Advocate by the Delhi High Court in 2013, marking the first time that an intellectual property lawyer has been given this title.
On May 15, 2017, she was appointed as a Permanent Judge of the Delhi High Court.
