I raise a question today- What is the purpose of punishment? Is it to root out the crime or just to rehabilitate the criminal. The advocates of human rights say that capital punishment violates the human right and right to life. It is a legal process in which a person is hanged to death as a punishment for a crime he/she committed. It is like a disease which needs a complete course otherwise it may occur or appear again. So it is important not just to weed it but to root it out. It is not just criminal who is hanged but the crime too.
What people fear today is death which is ironical for death is inevitable. But here the way death is netted is important. Capital punishment is just a penalty for the atrocious crime. It is morally justified. Punishment must be so painful for the heinous crime that the other criminals deter rather fear to do it. This punishment will not allow ideas of crime to arrive in the mind of the person. Capital punishment is the ultimate warning against all crimes. It is a good tool to deter crime for police and prosecutor. So this punishment is not just hanging criminal but also removing the crime for if we see countries where capital punishment is not banned people are scared to even think about it for the fear of the penalty. This punishment automatically remove crime and the ideas will also not arise. It is an ultimate warning against all crime. But in countries where hanging the criminal till death is banned, crime is breeding and spreading along with criminals. So let’s make stringent laws to root out the crime. A system in place for the purpose of granting justice cannot do so for the surviving victims unless the murderer or the rapist himself is not put to death.
The existence of the death penalty in any society raises one underlying question: Have we established our judicial system out of a desire to rehabilitation or out of a desire for retribution.
However, Capital punishment is not doing its job. It has not yet created the fear it was supposed to be in the hearts of the criminals. Let’s take Nirbhaya case for example. The 2012 Delhi gang rape and murder case[1]– Jyoti Singh, a 22 year old woman was beaten, gang-raped , and tortured in a private bus in which travelling with her male friend. On 20 March 2020, four of the convicts were executed at Thar Jail. They were hanged on a gallows specially designed for four people.
Yet every year thousands of rape cases are reported in India. Several sexual assault cases go unreported every year in this country. Where is the fear? The nation wished to create a model example out of such criminals who are hanged till death and yet this country fails to do so. In countries where capital punishment is not banned, crime rate and criminals are increasing by leaps and bounds.
