Capital Punishment in India

Capital Punishment is said to be a legal penalty in India. This comes under the country’s substantive penal legislation which gives some permission for the crimes in Indian Penal Code as well as other laws. According to the statistics in death row, there are 403 prisoners in India. The recent executions happened in March 2020 when the Nirbhaya 2021 Delhi gange rape murder happened. Those perpetrators were executed at Tihar Jail in Delhi. Capital Punishment is included in both iPC and non iPC sections. For example, it includes criminal conspiracy, treason, mutiny, conviction, suicide, murder, kidnapping, rape and dacoity. All these examples fall under IPC Sections of Capital Punishment. The non IPC Sections include organized crime, desertion, mutiny, civil offenses, abetting sati and repeated commision.

Now there are categories of people who have been exempted from the capital Punishment. In the Juvenile category, Section 21 of the Juvenile Justice act says that no child who will be in conflict with law shall be sentenced to death. In a ruling Shatrugan Chauhan vs Union of India, the people did suffer mental illness and insanity.
