CEDAW and India’s progress towards – discrimination against women

Yes, women have brains as that of men, yes women have hands as that of men. So when a men can think and imply so can a women. But still the voices of women have always been something out of culture. Male dominancy in almost every field is a clear support to this statement. Shockingly, the legal field of laws, rules and legislations that is responsible to form egalitarian laws and make a change is also a top count in the fields that are male dominant. A female lawyer’s voices are always the ones that never gets to reach significant ears. The number of females justices in our system and legislators in our system keeps a clear transparency in sighting the discriminative approach.

Therefore, the main aim of this article is to spread light over some provisions fabricated to deal with this ill practice. Thus, article is presenting some national and an international(CEDAW Act) provision that came out to sweep away such discrimination against women.

CEDAW Act, 1979 is a Convention on the elimination of discrimination against women. It is an international bill of rights for women which gave significance to rights of women at an international level. It consists of a preamble and thirty articles which are concerned with way to evolve and better the conditions of women at every possible nook and corner of the world. Main goal lines of this convention is to –

Call for equality among men and women by keeping aside the traditional differences that kept women aloof despite the fact that they can work as good as men.

Place responsibility on different states to formulate policies, schemes, legislations, etc to look after women rights.

Deal with family issues, health issues of women, including awareness about reproductive health. Promoting economic participation by women. Introducing amendments in some cultural and political participation rules.

Call for women participation in public offices, trade unions, etc., fabricating laws to enable women to access bank loans.

Call of all kinds of discrimination against women worldwide like that of taking away citizenship of a women who marries a men of foreign country but not the men who do the same. No property possession by women in many parts of the country.

Promote equal opportunity in field of education, sports, arts, etc and letting down female dropout rates.

Now if we look at national level. India has worked progressively towards this issue. Here are some judgements in support of this claim-

Maya Devi Vs. State of Maharashtra, in which one of the custom belief of state was struck down which stated that married women before working out of home should seek permission of her husband.

Muthamma Vs. Union of India, where a rule of Indian Forest Services was led down according to which a female candidate in the service should take permission of government before she gets married.

Air India Vs. Nargesh Mirza where airlines were instructed to struck down the rule of dismissing airhostesses from their jobs after pregnancy.

Many legislations like-

Equal renumeration Act, which ordered every public and private entity to pay equal wages to men and women for equal work was introduced to end gender discrimination.

Dowry prohibition act to end this torturous system of dowry was enacted by Indian government to end atrocities against girl and the families of females.

Thus, all stated above shows the force applied both nationally and internationally to stand against this age long issue of gender discrimination. But, still the goals are half fetched and rest is waiting. This legacy has to go on until every turn of this globe becomes unbiased towards women and women fraternity nowhere finds a place in the list of vulnerable sections of society.
