The Indian Penal Code considers cheating to be a criminal offence. It is done in order to get an advantage or acquire money from another person via deception. The individual who deceives another is well aware that he or she is putting the other person in an unfavorable situation. Cheating is a criminal offence under Section 420 of the IPC.
Cheating is defined under Section 415 of the Indian Penal .
If a person fraudulently, dishonestly, or wilfully encourages another person to do or omit to do something that he would not have done if he had not been fooled, and the act causes harm to that person’s body, mind, reputation, or property, that person is said to cheat.
Cheating is defined as any dishonest concealing of information that deceives a person into performing an act that he would not have done otherwise.
DECEPTION
Deception is one of the most crucial factors in the offence of cheating. Deception can be used to persuade the other party to deliver or keep the property, or to perform an act or omission. By employing words or conduct, deceiving implies persuading someone to believe what is untrue to be true or disbelieving what is true to be false.
In the case of K R Kumaran vs State of Kerala, a patient who was admitted to the hospital was examined by a doctor, who determined that the patient was in a situation in which he would not survive. The doctor collaborated with the other defendants to issue a life insurance policy for the person who was about to die, and he certified that he was fit and healthy in order to do so. The accused did this in order to collect the money from the insurance company after the patient passed away. The court found the defendant guilty. Under the IPC, the accused was found guilty of cheating.
A fraudulent representation or purposeful misrepresentation of a truth is made in deception, either directly or indirectly, with the goal to cheat. To prove the charge, it is necessary to show not only that the accused made a false representation, but also that the accused knew the representation was false and did it intentionally in order to deceive the prosecutor. If the accused knowingly makes a false representation, he or she may be charged with cheating under the Indian Penal Code.
MENS REA
Mens rea refers to a person’s mental state or intent when they commit a crime. It is the accused’s mental condition that is taken into account while determining criminal responsibility. Mens rea must be established because it is a necessary component of the cheating offence. It must be proven that the accused purposefully committed the crime of cheating with a predetermined strategy. If mens rea for the crime is established, the accused might be held accountable for cheating under the IPC.
PUNISHMENT
Section 417 of the IPC makes Simple Cheating illegal. Section 417 of the Indian Penal Code indicates that anyone found guilty of cheating faces a sentence of imprisonment for a term up to one year, a fine, or both fine and jail.
The offence is penalised under Section 420 of the IPC if the deception results in the delivery or destruction of any property or the alteration or destruction of any valued security.
It is necessary to prove that the complainant relied on a false representation and that the accused intended to deceive the complainant under Section 420 of the IPC.
INFERENCE
Cheating can be done by someone in a fiduciary relationship, and it has an effect on the individual who has been defrauded. In order to deceive the other party, a person can cheat by misrepresenting facts or utilizing fake proof. The individual who has been fooled believes the deceiving party’s representations to be real, which has a negative impact on the person’s mental and physical well-being. Cheating can cause worry and strain, as well as have a negative impact on one’s mental health. It can also cause trust issues, making it difficult for the individual who has been duped to trust someone else again.
