Nowadays, India faces many problems in the way of development. Child labor is one of the main problem which is faced by the children in India. Mainly children belong to poor family.
Child labor means the employment of children in any kind of work that harm them in both physically and mentally way. It deprives them of their basic educational and recreational requirements. A large number of children are included in works like agriculture sector, glass factories, carpet Industry Matchbox Industry and other domestic help.
Childhood is the best time of everyone’s life but unfortunately this does not hold true for many of the children’s who struggle to make both end meet during their childhood years.
According to 2011 census, 10 million children are engaged in child labor in our country India, out of which 4.5 million are girls.
Indian law prohibits the employment of children under the age 14 in occupations deemed hazardous, a list now include domestic, hotel and restaurants work. Under the law, government officials must remove and rehabilitate children, and prosecute employers illegally using underage children.
There are many factors that attributes to the rise of this peril.
# Poverty plays a major role in the development of child labor in India. Many of the poor families believe that every child is a bread-easer and children have to share the responsibility of parents.
#illitracy is another also prefer children on work rather than adults because they extract more work in less payment and other many of the factors are there.
Article 24 of the Indian constitution clearly states that, no child below the age of fourteen years shall be employed to work in any factory or mine or employed in any hazardous employment.
A legislative action plan: the government has enacted the child labor [prohibition and regulation] act, 1986 to prohibit the engagement of children in certain employments and to regulate the conditions of work of children in certain other employments. The act of prohibits employment of children in 13 occupations and 57 processes contained in part A and B of the schedule to the act [section 3]
A person who employee and children in contravention of the provisions of sector 3 of the act is liable for punishment with imprisonment for a term which shall not be less than three months but which may extend to one year or with fine which shall not be less than rupees 10,000 but which may extend to rupees 20,000 or both [section-14]
The central and the state governments enforce the provisions of the act in their respective spheres.
