The basic difference between Fundamental rights and Citizenship rights is that, Fundamental rights are the rights which are fundamental to citizen of a country and Citizenship rights are the basic human rights essential for all humans. Citizenship rights have 4 domains civil, political, economical and cultural and participation is the central pillar of them. Both the fundamental and citizenship rights explain a right or a duty of the citizen towards its nation. Many other times Citizenship rights are used as synonymous to Human rights. Such Human rights are also discussed by the United Nations Organisation which gives any citizen of a country to residential rights, educational rights, hygiene and extends to just trials. Fundamental rights are somewhat on the same level of Citizenship rights, the other difference is that Fundamental rights are written in the constitution, that is why it is also called as ‘Constitutional Rights’. The following discusses the same as personal freedom, public rights and their relation with the state.
Citizenship rights argue about the right of a citizen as a citizen of a country, which majorly focuses on their political and civil rights as a member of the society, along with the responsibilities of the society and governance of social order and recognition of these interactive rights. It main agenda is to maintain social order and justice in the society. Human rights are the controller of natural rights of a human being which are irrevocable, inevitable and which help in safeguarding the basic human rights of a being. .Human rights declaration and citizenship rights that dated 26 august 1789, by revolution of France that is specified by individualism and constitution laws of countries in the world have been derived from it, dose not separate human rights from citizenship and both of them, in fact, are applied as synonyms. A list of human rights has been declared in the charter of United Nations and Declaration of Human Rights, which include right to life, freedom, residence, equality, protection against each kind of torture etc.
Fundamental rights are the rights of the people which are protected when a citizen gives encroachment to the government. These are also called as individual rights sometimes, as it protects the Individual freedom from the powers delegated to the government. It is a legal binding wriiten in the Indian Constition, which also makes them constitutional rights. They are guaranteed to citizen irrespective of their race, caste, class, religion etc. Fundamental rights play an important role in developing the human personality. An Indian Citizen is ensured of these rights and the judiciary helps to protect them. Fundamental rights protect the interests of minorities to make a real Democracy. The constitution of India contains a list of fundamental rights in part III from article 12 to article 35 , right to equality ( Art 14- Art 18), right to freedom (Art 19 to Art 22), right against exploitation (Art 23 to 23), Right to freedom of religion (Art 25 to 28), Cultural and Educational Rights (Art 29-35) are provided in Indian Constitution.
