Commercial surrogacy refers to compensated surrogacy, in which the surrogate mother is paid a monetary sum in addition to reimbursement of everyday medical expenses for carrying a child in her womb. The Surrogacy (Regulation) Bill was approved in 2019 after nearly two years of discussion, making commercial surrogacy illegal.
Surrogacy is a procedure in which a couple hires or appoints a woman who agrees or willingly bears their kid in her womb in exchange for the parents of the kid after birth. Surrogacy can have two different forms:
- Traditional surrogacy: In this type of surrogacy, the egg donor is the surrogate mother, and the sperm donor is the intended father or an anonymous male. As a result, the kid is genetically linked to the donors listed above.
- Surrogacy in which the surrogate mother is not the egg donor (gestational surrogacy). The intended mother, or egg donor, and the intended father, or sperm donor, are genetically related to the kid. This is the most typical configuration produced since the introduction of in vitro fertilisation (IVF).
People who use traditional surrogacy may include:
- Single men
- Same-sex male couples
- Intended mothers who canot produce healthy eggs
People who use gestational surrogacy may include:
- People who have struggled with infertility
- Intended single parents, male or female
- Same-sex couples
- People who don’t want a genetic relationship between the surrogate and their child
- Anyone who cannot carry a pregnancy safely to term
In addition, there are other two forms of surrogacy.
- Surrogacy for a good cause: Aside from medical bills and insurance, the surrogate mother receives no monetary remuneration in this form of surrogacy. The surrogate mother is usually a close friend or family member who is willing to help without being materialistic.
- Commercial surrogacy: In this form of surrogacy, the surrogate mother receives monetary remuneration as well as medical expenses and insurance for her services.
