Constitution of India 4

  • Responsible Government- India is a Federal Nation where there exist Government at the Centre and State. President discharges only ceremonial functions and is called the Head of the State. But the main role is played by Prime Minister and his Council of Ministers

elected directly by the people. At the State level, there exists a Chief Minster and his Council of Minister and his Council of Ministers who are also directly elected by the people. President on the other hand is elected by the members of Parliament and members of State Assemblies.

Governor is the Head of the State in a State Government and is a direct nominee of the Centre. Hence the Governments have a direct responsibility towards the citizens for their welfare.

  • Fundamental Rights- Fundamental Rights have been enshrined in Part 111 of the Constitution of India. These Rights have been guaranteed to the people by the Constitution, certain basic human rights and freedoms. Fundamental Rights have been inspired by the American Bill of Rights. Though there may be some resemblance but it is pertained to state that Fundamental Rights in Indian Constitution are much detailed and elaborate than the American Bill of Rights.

The purpose of inserting the Fundamental Rights in the Indian Constitution was due to several reasons such as minorities in India, memories from the independence struggle against the British Rule, Gandhian Ideals and Principles etc. The Fundamental Rights have been conceived in a liberal spirit and seek to achieve balance between individual freedom and social control. Fundamental Rights can be violated by Private Individuals or the Government and in order to safeguard the Fundamental Rights of a Person Article 32 and 226 have been inserted in the Constitution as Legal Remedies.

  • Minorities and Backward Classes- One of the most important features of our Constitution is this that Laws have been made for the upliftment of minorities and backward classes in the country. Indian Society is not homogenous because there exists different religions, languages, culture etc. There are sections of people who are comparatively weaker than others economically, socially and culturally. Hence there are circumstances and situations when there exist distrust between various linguistic and religious groups.

Provisions have been made to promote a sense of security among the minorities, backward classes, schedule castes and schedule tribes. Provisions have been made to reserve seats in the legislatures in government services in order to promote seats in the legislatures in government services in order to promote the welfare of the depressed and backward classes and to protect the language and culture of the minorities.

  • Elections- India is a democratic country and elections are one of the fundamental principles of democracy. India adopted “Adult Suffrage” as a basis of elections to the Lok Sabha and a State Legislative Assembly. Every citizens be it a male or female, who has attained the age of 18 Years or Plus has a right to vote without any discrimination based on caste, religion, language, sex, race etc.

In order to vote in Indian the Constitution makes did not introduce any criteria of holding any property or educational qualification for exercising the franchisee (Voting Right) because this would have violated the principles of democracy.

To ensure free, impartial and fair elections and in order to protect the elections from any kind of manipulations at the hands of political parties or politicians, the Constitution sets up an autonomous body  known as the “Election Commission of India” To supervise and conduct elections to Parliament and State Legislative Assemblies in India.
