WHO ARE CONSUMER?

Section 2 (1)(d) of consumer protection act 1986 defines consumer as – A consumer is a person who purchase good and services with exchange of money for his personal consumption and not for resale. As for example, Saumya bought a scooty  for her personal use with a consideration of 60,000 rupee from Navya. Here , Nvya is a seller and Saumya is a consumer.

WHAT IS CONSUMER PROTECTION ?

Consumer protection means safeguarding a buyer of goods and services against the unfair trade practice in the market. This also prevent the business from engaging into fraud or unfair practices in order to gain huge profits.

WHAT IS CONSUMER PROTECTION ACT 2019?

Consumer protection Act 2019 come into force by replacing consumer Protection Act 1986. CPA 201 was passed in Lok Sabha on 30th July 2019. This  bill was passed in upper house on 6th August 2019 by the ministers of Consumer affairs, food and public distribution Late Ram Vilas Paswan.

Consumer Protection Act 2019 was introduced to protect the rights of the consumer, and to work effectively and speedly on the consumer’s grievances.

RIGHTS OF THE CONSUMERS

  • RIGHT TO SAFETY – This provide safety to consumers against hazardous good and services.
  • RIGHT TO BE INFORMED – The consumer has right to know about goods and services regarding their purity, date of expiry, date of manufacturing, quality, quantity etc.
  • RIGHT TO CHOOSE – The consumer has right to choose goods and services of their choice from the goods and services available in the market.
  • RIGHT TO HEARD – Under this consumer can file a complaint against the things which are prejudicial to their interest and they have also the right that their grievances to be heard.
  • RIGHT TO CONSUMER EDUCATION – This helps to educate the consumer about their rights and duties so that they don’t suffer a loss.

WHAT IS CENTRAL CONSUMER PROTECTION AUTHORIYY ?

Central Consumer Protection Authority (CCPA) has been established on 24th July 2019 under section 10 of Consumer Protection Act 2019.It helps to protect the rights of the consumer by cracking down unfair trade practices and false and misleading advertisement which are detrimental to the interest of the consumer.

PROHIBITION AND PENALITIES FOR MISLEADING ADVERTISEMENT

According to section 89 of Consumer Protection Act 2019, punishment for misleading advertisement is imprisonment of 2 years with a fine of 10 lakhs rupees; and for every subsequent offence be punished with imprisonment for a term which may extend to 5 years and fine which may extend to 50 lakh rupees.

 WHAT IS CONSUMER DISPUTE REDRESSAL COMMISSION ?

CDRC is setup as a quasi- judicial bodies at district, state and national level. This work as follows –

  • A District Consumer Dispute Redressal commission will hear complain upto 1 crore. Appeal from district level will be heard at state level
  • At state level the complain will heard of the value between 1 crore to 10 crore and appeals from here will be heard at national level.
  • At National level complaint will be heard where the value  exceeds from 10 crore and appeal from National level would be heard by Supreme court.

E – COMMERCE

E – Commerce means buying goods and services online ie. through internet. The new act empowers the central government to make laws and to protect consumer’s interest.

PRODUCT LIABILITY

 A manufacturer or  service provider is liable to compensate the loss incurred by the consumer.  Product liability includes manufacturing defect, design defect, falling to contain adequate instructions for the uses of the product etc.
