Custodial death in police stations, seems to be very commonplace these days. According to the recent data, custodial deaths are increasing day by day which led to the violation of human rights also. And recently CJI NV Ramana said that threat to human rights is highest in police stations. So various steps should be taken to protect human rights by decreasing the custodial deaths in the police stations.
There are various recent cases of custodial death, some of them are listed below:
1. The death of a fruit stall owner,47 year old, A murugesan, allegedly as a result of a brutal thrashing by a special sub inspector of tamilnadu police.
2. Bennix and his father jayraj who died in custody last year in june in thoothukudi.
3. An army man resahm singh was brutally tortured while his mother and two sisters in pilibjit, UP, were humiliated on may 3, drawing the Allahabad high court’s ire.
4. On may 21, an 18 year old vegetable vendor faisal hussain was allegedly beaten to death in bangarmau police station in UP’s unnao district for violation of covid 19 directives.
Causes due to which the vulnerable people suffer 3rd degree treatment:
1. Police force is not trained enough in human rights reveal surveys, crime records and survey reports show that violence by police has been reported across the nation.
2. It is supposed that the practice of torturing suspects in police custody to punish them, gather information, extract confessions, or demand bribes, was rampant.
Steps that should be taken:
In NALSA event CJI NV Ramana said that the threat to human rights and bodily integrity are the highest in police stations. custodial deaths and violation of human rights takes place because, in spite of constitutional declarations and guarantees, the lack of effective legal representation at the police stations is huge detriment to arrested or detained persons. Custodial torture and other police atrocities are problems that still prevail in our society. He also added that, in every police station there should be display boards or outdoor hoardings on which all the rights of common people and all the duties of police force are very clearly mentioned. So that every common man know his rights and use them efficiently to take justice. And another step that should be taken is that, to keep police excess in check and the same will be possible when common man is awared about his basic rights like getting of free legal aid service and must have knowledge about the constitutional rights which are given in article 31A and article 21. He called upon NALSA to carry out nationwide sensation of police officers. Reforms should be there in the police services and have training of human rights so that they can understand the value of human rights which ked to decrease in violation of human rights in police station. Another step should be that pro bono services should be rendered to poor section of the society. Project “access to justice” has also been started so that equality should be there while getting justice.
Conviction of policemen
1. While several policemen do get convicted there are good reasons to believe that many go scot free – by manipulating records, intimidating complainants or political patronage.
2. It is up to senior officers to ensure that prompt actions are initiated against policemen who resort to brutal torture.
3. When erring personnel are promptly punished, the message goes out loud and clear to other rogue policemen that the law will catch up with them.
4. In the case of custodial deaths, those guilty should be tried for murder.
So, these steps should be taken to reduce or to stop the gross violation of human rights.
