Today, as people from every nook and corner of the globe are on the screens, enhancing provisions of cyber laws can be surely determined as the need of an hour to protect all global citizens and fabricate legal provisions the same way as are provided to them in person. Horizons of services and commodities available on screen is escalating day by day from online purchases of clothes to that of currency thus leading to many cybercrimes such as data theft, identity theft, DDos(Distributed denial of services) attacks and much more. But since internet and its related provisions are something of a new kind, many governments and authorities lacks in formulating policies regarding the same and for protecting the citizens from e – threats, as once pronounced by US Supreme Court, the third party doctrine states that a person has no right to privacy over data that is voluntarily shared with a corporation, even today this precent is cited before courts around the globe and this showcases the inefficiency of legal aid in the virtual world.
Recently, a cybersecurity attack happened in India and the personal data like passport detail, credit card details, etc. of the passengers of Air India was breached. Such incidents are alarming for the governments and authorities at national and international level to develop cyberlaws not just to protect government servers and information but also to protect every single citizen from daily cybercrimes like social media identity theft and much more.
Also there has been many cyber crimes taking place in financial world which is an alarming issue. Like, in one of the cases, an ex employee of a BPO company performed a fraud of 1.5 crores with the U.S customers of Citibank Pune by holding unauthorized access to their electronic account space. Such offences questions the data protection strategies and technologies used in a nation. Thus, demanding hefty legal provisions in IPC apart from just ITA-2000.
India has recently introduced new IT rules for social media platforms like signal, Telegram, WhatsApp, etc. to keep a track of people with unlawful identities who spread unlawful messages and had asked these platforms to assist governments in dealing with such malpractices. United Nations Office on Drugs and Crime is also recognizing the need to build up capacity tool to deal with cyber crimes, create related awareness and look into provisions and working of criminal justice systems to deal with such matters.
But there is much more that needs to be done like promotion of courses like ethical hacking for legally dealing with the subject, introducing laws that checks the privacy and security of global citizens but doesn’t hamper their accessibility to growth and development. According to Global Cybersecurity Index, some countries that are best in terms of legal, technical, organizational, building capacity and cooperation are United Kingdom, France, etc. and also includes some small countries like Estonia, Lithuania and Malaysia which is a clear indication that all that is needed is profound strategies, framework and awareness to understand the significance of virtual world and that of legally regulating it.
