Equality before law or Equal protection of law

Equality is one of the most important thing in this 21st century as earlier in past there is no equality like equality in between the Gender where man are always superior to women. Equality among the colors or racism the people who  are having bright or fair color are suppress the dark color people and equality on cast that person who is of lower cast he/she always ruled by the upper or superior cast. But as the time changes things are also changes now most of the people believe in equality and as women’s can also do what mans do so for equality lots of laws are  introduced and on those laws it is also mention that before fulfilling or completing the laws one must be equal to everyone. Some of the laws are given below-

  • Article 14 says that state shall not deny the persons equality before the law or equal protection of law in the territory of India on the basis of caste, creed, religion, sex or place of birth.
  • Article 15 states that any citizen can not  be discriminate on the grounds of caste, gender, race and birth place
  • Article 16 states that every citizen has equal opportunity for employment or appointment to any office under the state
  • Article 17 states that there is abolition of untouchability everyone has equal right
  • Article 18 states that there must be an abolition of titles except those which are comes from the military or academics. The titles which comes from the foreign states means which are given by the British government must be abolished.

These laws basically means that all the persons are treated equally whether they are rich or poor, male or female and of any caste .The law is not going to provide any special privileges to anyone in the country so it is considered as the legal equality. It is also remember to everyone that law is equal for everyone so one must have protect the law before anything else not like if you have power to enjoy the law so you just go and simply misuse it that it is harmful for themselves.

Equal protection of laws is one of the positive concepts of the equality it is incurred from the section 1 of the 14th Amendment act of the US constitution so this law states that the any person who is living in India have equal right to enjoy the laws as well as to protect the laws means everyone be treated equally. It is not just applicable to the Indian citizen but the person who comes from the foreign country they can also be treated equally according to the Article 14 which talks about the right to equality. Quall treatment should be given under the equal circumstances both in the privileges conferred mad the liabilities imposed by the laws and foreigners are also traded equally without any discrimination.

Equality also has some exceptions like there are no criminal proceedings to be continued against the President or the governor in any of the court during their term of office. As well as no court can issue the warrant for arrest to the President or governor during their term of office and the foreign ambassadors  and the diplomatic persons will be free from any of the criminal and civil case. So these are some of the exceptions where persons are not treated equally. Though the concept of equality is very clear that it is for the benefits of the citizens or the people who come to India for any of the purposes.
