Essentials of a valid marriage are defined under section 5 of the Hindu Marriage act. It states
that A marriage may be solemnized between two Hindus if:
- Neither party has a spouse living at the time of marriage
- At the time of marriage:
i. No party is of unsound Mind, or is not capable of giving a valid consent
ii. A party is able to give a valid consent but has been suffering from mental
disorder of such a kind or to such an extent as to be unfit for marriage and
the procreation of children.
iii. A party is facing attacks of insanity
iv. The bridegroom has achieved the age of 21(twenty-one) years and the bride,
the age of 18(eighteen) years.
v. The parties are not within the degree of prohibited relationship
Prohibited degree: It is a degree of blood related-ness, for the groom it is
examined till the 5 th generation and for the bride it is looked till the 3 rd
generation.
vi. The parties are not sapindas to each other unless a custom or usage allows
them to do so.
Sapindas: lineal ascendants
Another essential for a valid marriage is Satpadi(section 7)
For a valid hindu Marriage satpati should be performed section 7. Seven steps after pheras
if satpadi is not performed Then there is no marriage in eyes of law.
