Forgery in short.

Introduction

Forgery is the action of the copy or imitation of the real documents, signatures, banknote,etc.

In simple words, copying a valuable or legal document for wrong use to deceive others is forgery and those who commit this offence are charged under “crime of fraud”. Documents that can be the subject of forgery include contracts, identification cards, and legal certificates.

Definition

Forgery is defined under Section 463 of Indian Penal Code, “Whoever makes any false document or false electronic record or part of a document or electronic record, with intent to cause damage or injury, to the public or to any person, or to support any claim or title, or to cause any person to part with property, or to enter into any express or implied contract, or with intent to commit fraud or that fraud may be committed, commits forgery. “

Types of forgeries are as follows:

Tracing – Tracing can be done with the help of tracing paper

Simulation – Simulation involves the copying of writing from a genuine article, by trying to imitate the handwriting of the original.

Freehand – Freehand forgeries are written with no knowledge of the appearance of the original.

Lifted forgery – The final type of forgery is lifted forgery, in which sticky tape is used to lift a signature from one document to another.

Illustrations:

Aman picks up a cheque signed by Jack, payable to bearer but without any sum having been inserted in the cheque. Aman fraudulently fills up the cheque by inserting the sum of ten thousand rupees. Aman commits forgery.

Conclusion

Section 463 states that intention is essential. The intention is the essence of the offence of forgery. To state that, some damage or injury must be intended to be caused by the false document to an individual or to the public.

A charge of forgery often leads to intention, the burden of proof is on the prosecution to prove that the intention of the accused beyond a reasonable doubt.
