Article 19 (1) (a) of the Indian Constitution deals with the freedom of the press in India. It gives rights to the press of India to act according to its own will and not take sides of any of the political components. The main question that arises in the minds is that if the media is adhering to it and should be under the guardianship of the government agencies to filter what all facts come in the light of the people and the global level.
It also includes all the emails, social networking, and newspapers in all forms. With the British Empire’s effect on India’s press, it has grown from being a dependent organ to being one that can run at an individual level. This also brings into light all are the duties of the press and how it has to confer them to the country’s people.
This research paper will try to answer that the should the press be tamed by government agencies. At a nurturing stage, it will also tell about how the press matured in India during the post-constitutional time. The method of research used in the paper is doctrinal.
The legal framework of freedom of the press is had been taken from international bodies like the US constitution, United Nations and the British Constitution. The primary document of the UN has laid particular emphasis and importance on the concept of freedom of speech and expression. The Universal Declaration of Human Rights, 1948 (Art. 19) reads: “Everyone has the right to freedom of opinion and expression, this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any medium and regardless of frontiers.”
To safeguard the democratic way of life, people must have the freedom to express their feelings and make their views known to the people. The press, a powerful medium of mass communication, should be free to play its role in building a robust and viable society. Denial of freedom of the press to citizens would necessarily undermine the power to influence public opinion and be counter to democracy.
Freedom of the press is the opportunity of communication and expression written matter including different electronic media and distributed materials. While such opportunity generally suggests the absence of interference from the state, its safeguarding might be looked for through established or other security.
The Universal Declaration of Human Rights expresses that in the activity of the rights and opportunities, everybody will be subject just to such restrictions as are dictated by law exclusively to make sure about due acknowledgement and regard for the rights and opportunities of others and to meet them only prerequisites of ethical quality, open request and general government assistance in an equitable society.
Other than the limitations forced on the press by the Constitution, there exists different laws which further cut down press opportunity and the privilege of the resident to information just as the privilege to the right to speak freely of communication and expression. They are all in power in light of a legitimate concern for the open request of the sovereignty and security of the state.
