The FREEDOM OF SPEECH AND EXPRESSION is a FUNDAMENTAL RIGHT guaranteed to all citizens under the CONSTITUTION OF INDIA. Article 19(1) (a) of Indian constitution states that,” all citizens shall have the right to freedom of speech and expression.” This freedom includes, every individual has the right to express their views and opinions on any matters by words of mouth, printing, writing, movie, etc…
The FREEDOM OF SPEECH AND EXPRESSION includes;
(a) FREEDOM OF PRESS: FREEDOM OF SPEECH includes the right to express one’s views through print media or any other communication medium. FREEDOM OF PRESS includes FREEDOM OF PUBLICATION, FREEDOM OF CIRCULATION AND FREEDOM AGAINST PRE-CENSORSHIP.
(b) FREEDOM OF COMMERCIAL SPEECH: Supreme court held that commercial advertisement or commercial speech are also the part of FREEDOM OF SPEECH AND EXPRESSION.
(C) RIGHT TO BROADCAST: THE RIGHT TO SPEECH AND EXPRESSION is available in all means of expression and communication, includes in all electronic and broadcast media.
(d) RIGHT TO INFORMATION: FREEDOM OF SPEECH AND EXPRESSION not only consists of right to express, publish but also to seek information. This right includes that all individuals should have the right to seek and receive information regarding all matters in the nation.
(e) RIGHT TO CRITIZE: Everyone has the right to express their own opinion on any general issues.
(f) RIGHT NOT TO SPEAK OR RIGHT TO SILENCE is also included in the right to speech and expression.
In certain grounds FREEDOM OF SPEECH AND EXPRESSION could be restricted. Article 19(2) of INDIAN CONSTITUTION imposes certain restrictions on freedom of speech and expression. They are:
1. SECURITY OF THE STATE
2. PUBLIC ORDER
3. DEFAMATION
4. DECENCY AND MORALITY
5. CONTEMPT OF COURT
6. FRIENDLY RELATION WITH FOREIGN STATE
7. INCITEMENT TO AN OFFENCE
8. SOVERIGNTY AND INTEGRITY OF INDIA
Right to freedom and speech is a very important FUNDAMENTAL RIGHT. The right to freedom and speech and expression is not just limited to expressing one’s own view through words but also includes expressing their views through various modes. It includes right to seek and receive information, right to critize, right to speak or not to speak etc…
For a proper function of a demographic state the concept of FREEDOM OF SPEECH AND EXPRESSION is very essential.
