Fundamental duties refer to the moral obligations of all citizens to help promote a spirit of patriotism and to uphold the unity of India. Carrying out the fundamental rights are expected from the citizens. Fundamental duties are set in part IV-A of Indian Constitution. The Supreme Court of India makes it obligatory of each and every citizen of India. Fundamental duties are important to maintain harmony and peace among citizens. It also encourages a feeling of brotherhood and oneness among citizens. Fundamental duties uphold and protects the unity, integrity and sovereignty of our country. The rights and duties go hand in hand. So, it is the moral obligation of people of India to follow these duties. The 42nd Amendment Act 1976 included fundamental duties in the constitution. Under Article 51A of Indian Constitution fundamental duties are enshrined. Earlier, fundamental duties were ten in number. However, by the 86th Amendment.
Features of Fundamental Duties
- Under fundamental duties both civic and moral duties are constituted.
- Fundamental duties are only restricted to the people of India. It cannot be applied to foreigners. Whereas, the fundamental rights can be applied to foreigners.
- The fundamental duties are not enforceable in nature.
Fundamental Duties
According to Article 51-A of Indian Constitution it shall be the duty of every citizen of India-
1.To abide by the constitution and respect its ideal and institutions, the National Flag and the National Anthem;
2. To cherish and follow the noble ideals which inspired our national struggle for freedom;
3. To uphold and protect the sovereignty, unity and integrity of India;
4. To defend the country and render national service when called upon to do so;
5. To promote harmony and the spirit of common brotherhood amongst all the people of India transcending religious, linguistic and regional diversities, to renounce practices derogatory to the dignity of women;
6. To value and preserve the rich heritage of our composite culture;
7. To protect and improve the natural environment including forests, lakes, rivers, and wild-life and to have compassion for living creatures;
8. To develop the scientific temper, humanism and the spirit of inquiry and reform;
9. To safeguard public property and to abjure violence;
10. To strive towards excellence in all spheres of individual and collective activity, so that the nation constantly rises to higher levels of endeavor and achievement;
11. who is a parent or guardian, to provide opportunities for education to his child, or as the case may be, ward between the age of six and fourteen years.
Conclusion
Fundamental duties are an integral part of Indian Constitution. A society cannot be a civilized one until and unless the citizens perform their duties. Citizens must enjoy the rights given to them but they should also perform the duties which is towards the country.
