FUNDAMENTAL DUTIES UNDER INDIAN CONSTITUTION 

Part IV (A) Article 51 A of the Indian Constitution prescribes Fundamental Duties of every citizen. Fundamental Duties which are expected to be carried out by the citizens of our country. It is a moral obligation on the citizens to maintain feeling of patriotism and unity among all the citizens of the country.

Fundamental Duties are applied only to the citizens of the country, not to any organ of the state. Article 51 A prescribes 11 Fundamental Duties 10 duties are formed on 42nd amendment and 11th duty was formed on 86th amendment 2002.These Fundamental Duties are not enforceable by law. 

FUNDAMENTAL DUTIES: 

  1. We need to follow our Constitution and should respect our National Anthem. 
  1. Should follow the ideals of the freedom struggle. 
  1. Protect the Sovereignty and Integrity of our nation. 
  1. Protect our nation and provide national services when required. 
  1. Should have the spirit of a brotherhood. 
  1. Preserve the culture of our country. 
  1. Protect the environment of our country. 
  1. Generate scientific rationale for every thought. 
  1. To protect public property. 

10. It is the duty of every parent to send their children between 6 – 14 years to school. 

NEED FOR FUNDAMENTAL DUTIES 

Our Constitution provides us various rights so in return we need to perform certain duties. Fundamental Duties and Fundamental Rights are like two sides of coin which cannot be separated. Rights and Duties go hand in hand and cannot be separated at any cost. The main aim of Fundamental Duties wasto maintain the sovereign nature of our nation. Our Fundamental Duties help in developing the feelings of unity and integrity among citizens of our nation. These duties help in order to create a balance between the claims of the individual citizen and those of the civil society. It helps in the interpretation of different statues which are made by the legislature.

 ENFORCEMENT OF DUTIES 

Directive principles of State Policy (chapter-IV of Indian Constitution) and Fundamental Duties both have a moral obligation on the state and its citizens. 

Section 3 of the Prevention of Insults to National Honour Act, 1971 is an act that prevents the citizens of our country from dishonoring the country. It includes dishonoring the National Flag and Constitution of India. All the citizens should be punished if they intentionally prevent the singing of the National Anthem or causes disturbance to an assembly which is busy in such singing. 

The Fundamental was added in our constitution as our government realized that a civil society cannot be made by the state only the citizens of our nation also need to play a vital role in achieving the basic aim of our constitution.
