WHAT IS FUNDAMENTAL RIGHT ?
Fundamental Rights are basic human rights which is provided to every citizen of India. These rights are applied without facing any discrimination on the basis of race, religion, gender, color of the skin, caste etc.
Fundamental Rights are enforceable by the courts and they cannot be violated.
If ones fundamental right is violated then a person can approach to the court of law.
HOW MANY FUNDAMENTAL RIGHTS ARE THEIR ?
There are six fundamental rights, which are provided to all the citizens of India. They are –
- RIGHT TO EQUALITY (ARTICLE 14-18) – Right to equality means that every citizen are treated equally before the law, regardless that they are poor or rich, men or women, white or black etc. This means that the law applies to everyone is same manner without discriminating anyone. Everyone has right to get equal job opportunities, educational opportunities, equal respect etc.
- RIGHT TO FREEDOM (ARTICLE 19-22) – Right to freedom is most important fundamental rights which are cherished by the citizen. Freedom is essential because it enhances ones expression of creativity, provides with original thoughts etc.
Right to freedom includes –
- FREEDOM OF EXPRESSION – This ensures that people can exchange their ideas and thoughts, and could freely express their views .
- FREEDOM OF SPEECH – This guarantee people to speak freely without any restrain.
- FREEDOM OF ASSEMBLY WITHOUT ARMS – This guarantees public to hold public meeting and promote their ideas.
- FREEDOM OF ASSOCIATION – This provides a person to join or leave groups voluntary, right to take actions for the interest of its member etc.
- FREEDOM TO PRACTICE Any profession – This provides right to practice any profession or to carry on any business or occupation to all the citizens of India.
- FREEDOM T6O RESIDE IN ANY PART OF THE COUNTRY – A citizen of India can reside in any part of country, which is subject to certain restrictions imposed by the state.
- RIGHT AGAINST EXPLOITATION ( ARTICLE 23-24 ) – According to this, the constitution of India prohibits child trafficking, child labour, forced labour or beggar where the workers are forced to work without wages. This protect citizens from being forced to work against their wishes.
- RIGHT TO FREEDOM OF RELIGION ( ARTICLE 25-28 ) – This provides every citizen of India to freely practice the religion of their choice and n o one has the right to interfere in his or her religious choice.
- CULTURAL AND EDUCATIONAL RIGHTS ( ARTICLE 29-30) – All section of the society have right to save their culture, language . This also provides that no citizen shall be deprived of admission into any educational institution on ground of race, caste language etc.
- RIGHT TO CONTITUTIONAL REMEDIES ARTICLE 32 ) – Right to constitutional remedies id considered to be the most important fundamental rights because it provides protection of our fundamental rights. If ones fundamental rights are violated, then they can go to court of law.
IMPORTANCE OF FUNDAMENTAL RIGHTS
Fundamental rights are very important because they are the back bone of the country. This safeguard’s the liberties and freedom of the citizen against any invasion by the state. This is essential for the development of individual and the country.
