Fundamental rights are rights that have been recognized by the supreme court as requiring a higher degree of protection from government encroachment.
These laws protect these rights even from the governments themselves. These are basic human freedoms which every Indian citizen has the right to a proper and harmonious development of personality. These rights are universally apply to all citizens respective of race, place of birth, religion, caste, breed, color or sex.
Article 12 to 35 in part III of the Indian constitution deals with fundamental rights.
These rights including equality before law all are equal in the eyes of law.
While the constitution also creates other rights, such as right to poverty these are not fundamental rights.
Fundamental rights for Indians have also been aimed at overturning the inequalities of pre-independence social practices.
Fundamental rights were included in the constitution because they were considered essential for the development of the personality of every individual to protect the rights of individual and to preserve human dignity.
Article 14-18 the right to equality
According to this everyone is equal in the eyes of law. There is no discrimination on the basis of cast, race, sex and religion.
Article 19-22 Right to Freedom
Right to freedom guarantees freedom of citizens to live a dignity among other things. It gives citizens basic freedom of person liberty, freedom to live a life of dignity.
Article 23-24 Right Against Exploitation
It guarantees human dignity and protect people from any such exploitation. It prohibits the trafficking of humans, begin any similar form of forced labor.
Article 25-28 Right to Freedom of Religion
It guarantees freedom of religion to all people in India. Every one has right to choose their religion without force.
Article 29-30 Cultural and Educational Rights
It is measures to protect the rights of cultural, linguistic and religious minorities. it is to ensure that education is to be provided to all without any discrimination.
Article 32-35 Right To Constitutional Remedy
It empowers the citizens to move to count of law in case of any denial of the fundamental rights.
Any case related to fundamental rights person has a right for direct appeal in the supreme court. The courts can issue various kinds of writes protecting the rights of citizens. These writes are called habeas corpus.
A state of nation emergency has an advance effect on these rights. Under such a state, the rights conferred by article 19(freedom of speech, assemble and movement etc.) remain suspended. The president may be order to suspend the right to move the court for the enforcement of other rights as well.
