GENDER JUSTICE AND PANDEMIC

Gender justice is a human right where all women and girls are entitled to live their lives in dignity and freedom without any fear. Gender justice can only be achieved by sharing Powers and responsibility between men and women with out any dissemination. Women’s are considered as vulnerable , this is because the women around the world are facing discrimination and unequal treatment at home , at work palace, and in their communities. According to London school of Economics and Political Science/Udaya Shankar Mishra and William Joe /Global gender gap report 2021/Aug 2nd 2021 India ranks 140 out of 156 countries in the Global Gender Gap Index (GGI) 2021 .

Country like India where more women’s are subject to domestic violence. Domestic violence not only include physical assault, it can also be a thread, verbal abuse, emotional and mental abuse which cause a person to live in fear. Domestic violence is most likely caused by men to women and children. During the COVID 19 pandemic, women where more exposure to abuse. However violence against women within the family in India is complex in most of the case the violence take palace in demanding dowry. Even though giving and receiving dowry is a criminal offence and which is punishable under section 174 and section 176 of the Code of Criminal Procedure, 1973. People believe that dowry is something that shows the status.

Dowry has become common practice in India and also India has the highest number of dowry-related deaths in the world . Hon’ble Supreme Court expressed view In the case Virbhan Singh v. State of UP, (1983,AIR 1002, 1983 SCR (3) )600the Apex Court held that dowry deaths of young brides has been increasing in India, such evil crimes whenever proved, then stringent punishment must be imposed on the criminals.

The women facing violence since very long time, unequal power relations between men and women which led to domination over and discrimination against women by men . Role of gender inequality is demonstrated through domestic violence. Women facing gender inequality and domestic violence on daily basis most of the victims out of fear they hide the situation that they have been facing. Only few out of them come out with courage. As per the report of National commission for women There was a 46 per cent rise in complaints of crimes against women in the first eight months of 2021 over the corresponding period of last year, and over half of these were from Uttar Pradesh.

As per the estimation of WHO about one in three i.e.; thirty-five of every women and girls would have been subjected to either physical or sexual intimate partner violence or non partner sexual violence in their life . According to NFHS-5 data, 70 percent of women in the major States who faced physical violence. In India culture and tradition are given more priority yet the most enduring enemies of a woman ’s dignity and security are cultural forces that aimed at dominating men and subjugation of women.

The COVID 19 pandemic and lockdown has led to rise in domestic violence and domestic homicide. According to the National Crime Records Bureau’s (NCRB) latest data, domestic violence against women topped the list of categories of violence against women in India. The victims of domestic violence in India reported an increase in frequency and severity of violence against women during pandemic One third of women in India experienced any form of domestic violence during the COVID-19 pandemic. Increase in unemployment during the pandemic was a reason behind increase in interpersonal violence against women and they have been facing double pandemic.

As per the latest data of National Crime Record Bureau 2020 around seventy-seven rape case has been reported every day and eighty murder incidents took place on an average. During the out break of COVID-19 there were 28,046 cases reported in violations against women . Rajasthan has the maximum number of rape case and followed by Uttar Pradesh, Madhya in which maximum case were under husband or relatives cruelty. Women has been facing pandemic with in pandemic. Abuse against women and girls has been common during pandemic and gender abuse have serious concern about the safety of women in India. Only a minor part of women facing domestic violence come out there are still many victims often do not receive and adequate support and another important aspect of the pandemic is that the perpetrators get escaped from punishment. Unemployed women are more vulnerable to violence as compared to employed women. The reason is that there is no need for depending on the male partner for her needs and wants but whereas the unemployment and lack of empowerment make the female incapable to escape from abuse.

COVID 19 has effected very negatively on the victim as said earlier the women’s has faced pandemic with in pandemic. This period of pandemic women’s undergone emotional, physical, mental abuse . The Domestic Violence affect not only the victim but also it has greater impact on family, society and community . Only the domestic violence can be over come only through proper awareness and education among people about detrimental effect of domestic violence. Still there is a need for straight rule against the practice of domestic violence by imposing strict punishment on the government should take due care about the matter in curbing domestic violence issues and should provide instance medical aid to victims. Since domestic violence can even cause serious health issues. The most important thing is the attitude of society. People should get more socialized instead of minding there own matter it doesn’t mean that one should always encroach in to the neighbors privacy. It is something that people to come up with instead of turning blind eye towards the violence.
