Grave Concern by SC over fake news on Social Media

Fake news is news, stories created to deliberately misinform or deceive readers. Usually, these stories are created to either influence people’s views, push political agenda or cause confusion. There is no specific law against fake news in India. Free publication of news flows from Article 19 of the Constitution guaranteeing Freedom of Speech. Misinformation and disinformation spread in the media is becoming a serious social challenge. The Supreme Court had sought responses from the centre and others on a plea seeking framing of law to regulate social media platforms like Facebook and Twitter and make them responsible for allegedly spreading fake news and hate speeches.

The biggest problem is that nowadays people don’t research about the news and forward everything. Everyone has the right to freedom of speech and expression but it comes with certain restrictions. The Central Government has taken a significant step by issuing the IT Rules, 2021. The lack of a regulating mechanism has led to increase in people spreading fake news, forwarding videos and posts without researching.

Since the fundamental rights that have been expressed include certain obligatory duties and, from ordinary citizens to politicians, sportsmen and women, in our ultra – modern day, all judges suffer. The regulating framework should therefore obviously be sufficiently rigorous to reduce the threat of false news. There needs to be proper regulations over spreading of news so that the truth is presented before the citizens.

Like in the name of these rights various social media platforms as well as the media used to spread fake news resulting in communal hatred or defamation which strictly needs to be prohibited by a regulatory mechanism.

Social media is very important nowadays. It can be a blessing or it can be a curse depending upon the information shared by the people. If proper regulations and mechanism is made to discard fake news, it will be helpful for everyone in the society. In today’s time fake news is being circulated at a large level through social media and needs to be regulated in a correct manner. Lack of knowledge is biggest issue. Rights are important for everyone but misuse of these rights is not appreciated.

Spreading awareness is one technique to prevent fake news spread, other methods include educating people, persuading people to follow legitimate media outlets, and most importantly, becoming aware of the source of fake news and boycotting it accordingly. It is critical to recognize that not all news is relevant or comes from a credible source. Regulatory mechanism is much needed.
