Can a Common Man Get Gun License in India?
In accordance to a survey conducted by the American Medical Association, India holds third rank in the world in cases of Gun-Related deaths i.e. Guns has been most frequently used in the past recorded years of this country. This scenario is rather very shocking considering the fact that India has the strictest arms-possession laws. All the instances of gun-holding and gun-licensing are regulated under The Arms Act 1959 and The Arms Rule of 1962 and 2016.
Now, the question arises that under what circumstances can a citizen of India be awarded with gun-license?
Generally, gun-licenses are only given to people who succeed in proving that their life is under immense threat and they need gun as a tool of self-defense. However, any common person who is not holding any special portfolio under the government of India is not entitled to Gun-holding until and unless a proper legitimate reason is presented before the Government. They can be various reasons other than self-defense that are considered legitimate like Crop Protection and Sports.
Few Reasons are specified by law as well. Under The Arms Rules 2016,
Section 35 to 46.
They are as follows:
- License for killing of wild animals that endanger the human, cattle or crop life.
- License for sport activities like training and target practices.
- License for Sport Shooting Association.
- License for Shooting Ranges.
- License for Accredited Trainers.
- License to museums for gun-keeping.
- License to foreign nationals or sport persons participating in Shooting Championships in India.
- License for Firearm free zones.
- Acquisitions, possession and exports of Arms and Ammunition by tourists visiting India.
- And other various temporary categories for imports/exports licenses.
Procedure to obtain Gun-License in India
Section 13 of the Arms Act, 1959 Grants license of Keeping Guns to Indian citizens. However, there is a fixed and prescribed procedure by law for the same.
Given below is the prescribed procedure that must be followed if a person wants to obtain gun-license:-
- Step 1
First of all, you have to fill an application form which is easily available at website of Indian Ordinance Factory. You can also get this form issued by the District Superintendent of Police of your state.
- Step 2
After the successful submission of the application form, your background check will be initiated by the police. All the past records will be verified and if you have any criminal charges in your past life, your application will be straightway rejected. Make sure that all the details filled by you in the application form is purely authentic.
- Step 3
During the police investigation your character and relationship with your relatives and neighbor is also scrutinized and it is also tested whether you possess any anger management issues.
- Step 4
The DCP himself conducts your personal interview to assure soundness of your mind.
- Step 5
Before granting gun license to a person, the motive and purpose are verified and interviewed very carefully.
- Step 6
After the interview is completed, the DCP sends the final report to the Crime Branch and National Crime Records Bureau.
Once, all these steps are fulfilled successfully, a common man rightfully becomes eligible to keep a gun.
