How can we improve the present judicial system?

It is an obvious need to improve our present judicial system during these times. We all know that our Indian judiciary is considered one of the most important pillars because the highest official body can also be tried by the judiciary. I would like to quote a saying which is very essential in this regard “Justice delayed is Justice denied”. People face a lot of red tapism while dealing with plenty of legal issues. To improve the judicial system, the first and foremost thing will be to improve the number of judges so that its strength is increased. This is absolutely not easy but the government or its associates can encourage students to take up law in their higher studies and for this law colleges should also be increased. Secondly, courts should be open all 365 days. Nowadays, all people are very active and everyone is working around the clock.

So many people have so many cases, many are pending and many soon to be filed or going on. Still courts have summer, winter vacations and so many holidays and for all these, so many have to suffer or wait for a long time for hearing. The courts should be properly modernized and fast track courts should be introduced. As there are so many cases going on, first of all the destination of the case should be known and accordingly the actions should be taken. Then the judicial system should do away with the archaic laws and accept the present condition of the society before any judgement is taken by the system. And lastly, most importantly flippant cases should be non accepted. For example, a political person is very powerful and has a lot of monetary power so any of his cases are always given the first priority.

Even if the case gets dismissed afterwards, it wastes a lot of energy. So there should be a rule from the court itself that proper kinds of important cases should be accepted. Besides all these, we the citizens should also be knowledgeable and responsible enough to not go to the courts or lawyers with silly cases for personal profits and wasting the time of law. 

At last I would like to conclude with the fact that independence and efficiency is the most important and essential thing which should always be kept first and foremost. 

The Supreme Court’s  Chief Justice Thakur lamented “inaction” by the Executive which has increased the number of judges to 40,000 from the current 21,000.  He has put the blame on the Centre for doing nothing to increase the number of courts and judges in the country. He accused the Centre of stalling appointment of judges to the High Court.

The common man’s faith in the justice and judicial system is at an all-time low. It denies the poor man and under trial prisoners their due of justice and gives preference to the powerful persons. Foreign investors are increasingly doubtful about the timely delivery of justice, which affects most the success of programs like ‘Make in India’.

The Judiciary is not able to handle the proper “avalanche” of litigation. Judiciary has  become overworked and lost its efficiency to the utmost.
