Protection of Human Rights
“Human Rights” means the rights relating to life, liberty, equality and dignity of the individual guaranteed by the Constitution or embodied in the International Covenants and enforced by Courts.
“International Covenants” means the International Covenants on civil and political rights and the International Covenant on economic, social and cultural rights adopted by the General Assembly of the United Nations on the 16th December, 1966.
The Protection of Human Rights Act, 1933 provides for the constitution and establishment of the following authorities :-
1) National Human Rights Commission.
2) State Human Rights Commission.
3)Human Rights Courts.
Functions of the Human Rights Commission.
The functions of the Human Rights Commission include the following :-
1) Inquire into violations of human rights or abatement thereof or negligence in the prevention of such violation.
2) Intervention in any proceeding involving allegation of violation of human rights pending before any Court, with the approval of such Court.
3)Visit jails to study the living conditions of inmates and make recommendations.
4)Review legal safeguards for the protection of human rights and recommend measures of effective implementation.
5)Review the factors, including acts of terrorism that inhibit the enjoyment of human rights and recommend appropriate remedial measures.
6)Study treaties and other international instruments on human rights and make recommendations for their effective implementation ( for National Human Rights Commission only ).
The commission after inquiring into the complaints may take the following steps :-
1)Recommendation to the concerned Government or authority to initiate prosecution against violation of human rights.
2)Approach the Supreme Court or High Court concerned for such directions, orders or writs as that Court may deem necessary.
3)Recommend to the concerned Government or authority for the grant of such immediate interim relief to the victim or the members of his family as the commission may consider necessary.
The Act also provides that where the Government considers it necessary so to do, it may constitute one or more special investigation teams, consisting of such Police Officers as it thinks necessary for purpose of investigation and prosecution of offences arising out of violations of human rights.
