Meaning of Impeachment
Impeachment is defined as the act of questioning something’s integrity or validity. The term impeachment refers to the procedure for removing a person in a position from all of the powers and obligations that the post requires. Impeachment is the term used to describe the complete process of removing someone from office.
It usually refers to the President, judicial judges, and other constitutional officers. Impeachment refers to a claim of misbehavior levelled against a public official in a country with a federal presidential Constitutional republic government.
Procedure of Impeachment
In India, there are two types of impeachment:
- The impeachment of the President of India — Article 61 of the Indian Constitution
- The Supreme Court Judge’s Impeachment – Article 124(4) of the Indian Constitution
According to the Oxford Law Dictionary, impeachment is “the act of charging a prominent public figure with a serious crime or the action of calling into question the integrity or validity of something.” Similarly, impeachment of the president under Article 61 of the Indian Constitution refers to “the act of violating the constitution,” and the president of India is impeached on these core aspects.
The President’s elections, mode of elections, power, qualification of the president, tenure in office, impeachment procedure, and re-elections are all covered by Article 52-62 of India’s constitution.
The method for impeachment of the president is outlined in Article 61 of the Indian Constitution, which outlines how a president can be impeached and the steps that must be taken.
Article 61 of the constitution of India states-
- If a President is to be impeached for violating the Constitution, either House of Parliament may bring the case.
- No such charge shall be preferred unless
- (a) the proposal to prefer the charge is contained in a resolution that has been moved after at least fourteen days’ written notice has been given by not less than one fourth of the total number of members of the House of their intention to move the resolution, and
- (b) such resolution has been passed by a majority of not less than two thirds of the total membership of the House.
- When either House of Parliament prefers a charge, the other House investigates or causes an investigation into the charge, and the President has the right to appear and be represented during the investigation.
- If, as a result of the investigation, a resolution declaring that the charge preferred against the President has been sustained is passed by a majority of not less than two-thirds of the total membership of the House by which the charge was investigated or cause to be investigated, such resolution shall have the effect of removing the President from his office as of the date on which the resolution is so passed.
