WHAT IS THE NATIONAL REGISTER OF CITIZENS?
National Register of Citizens is the register containing names of Indian Citizens .After conducting the Census in 1951, a National Register of Citizens was prepared. This census involved showing the houses or holdings of each village in a serial order of each and writing on a prominent part of the wall of the house, a number indicating the number of persons staying therein. Updating of NRC involves the process of enlisting names of citizens based on Electoral rolls up to 1971 and 1951 NRC.
The register of citizens had details of each and every person enumerated during the Census of 1951. The register were carefully stored in the offices of Deputy Commissioners and Sub Divisional as per orders issued by the government of India in 1951. Later copies of the register were transferred to the Police in the early 1960s.
NRC VERIFICATION PROCESS AND THE ASSAM RECORD
The NRC updating process was started off in Assam as per an apex court order in 2013. The objective was to find out cases of illegal migration into Assam from Bangladesh. This process was carried out under the citizenship act, 1955 and according to rules framed in the Assam Accord.
The Assam Accord executed in 1985 is a Memorandum of Settlement between delegates of the Indian Government and the pioneers of the Assam Movement at Delhi on 15th of August 1985.
•The accord finished the Assam Agitation and prepared for the pioneers of the protest to shape an ideological group and form a government in the state of Assam.
• As per the Accord, those Bangladeshis who entered India between 1966 and 1971 will be banished from voting for a period of ten years. The Accord states that the international borders will be shut and all people who traversed from Bangladesh after 1971 are to be expelled.
• Though the agreement finished the disturbance, a portion of the key provisions are yet to be actualized, which has kept a portion of the issues continuing.
HOW IS THE VERIFICATION CARRIED OUT?
“The verification process began in April 2015 and concluded on 30th August 2015. A total of 32 million people applied through 6 million applications. The process of verification involved going to individual houses for field verification deliberation on the originality of documents, family tree investigations in order to rule out fake claims of parenthood and linkages and holding separate hearings for married women”.
The NRC will be updated in accordance with the provisions of The Citizenship Act, 1955 and The Citizenship Rules, 2003 As per the two statutes, the eligibility status would be determined based on the NRC, 1951, Electoral Rolls up to 1971 and in their absence the permissible documents up to 24th March (midnight) 1971. The updated NRC will contain names of persons eligible for being included the National Register of Citizens by virtue of being original inhabitants of Assam.
The following individuals are eligible to be included:
1. Individuals whose names are found in National Register of Citizens,1951.
2. Individuals whose names can be seen in any of the electoral rolls up to 24th march (midnight), 1971.
3. Descendants of the above persons.
4. Individuals who came to Assam post 1st January 1966 but before 25th march 1971 and registered themselves according to the rules made by the central government with the foreigners registration regional officer (FRRO)[1].
As per a recent order of the Hon’ble Supreme Court, Indian citizens along with their children and descendants who have moved to Assam post 24th march 1971 would be qualified for being included in the updated NRC on producing satisfactory proof of residence in any area of India (outside Assam) as on 24th march, 1971
Every member of the tea tribes will be included under original habitants of Assam category provided under clause 3(3) of the schedule of the citizenship rules, 2003.
LEGACY DATA AND LIST OF ADMISSIBLE DOCUMENTS
The duo of documents including the 1951 NRC (National Register of Citizens) and Electoral Rolls up to midnight of 24th March, 1971 are together termed as the Legacy Data. It is the database which would list the names of a significant number of persons together, admissible to prove the claim for inclusion in National Register updated for Assam. One has to cite the proof of residence in Assam of himself or ancestors prior to 24th March, 1971 for being included in NRC.
There are 2 prerequisites for being included in the updated NRC–
1. The first prerequisite is producing of any of the accompanying records issued before of 24th March, 1971 where name of self or shows up (to demonstrate living arrangement in Assam up to 12 PM of 24th March, 1971
(1) 1951 NRC
(2) Electoral Roll till 24th March 1971
(3) Land & Tenancy Records
(4) Citizenship Certificate
(5) Permanent Residential Certificate
(6) Refugee Registration Certificate
(7) Passport
The Second necessity emerges if name in any of the archives of List An isn’t of the candidate himself/herself however that of a progenitor, in particular, father or mother or grandmother or grandfather or great grandfather of the candidate. In such cases, the candidate will need to submit documents as listed in List B underneath to set up association with such progenitor whose name appears in List A. Such documents have to be a document which proves the relationship the documents include:
(1) Birth Certificate
(2) Land document
(3) Board/University Certificate
(4) Bank/LIC/Post Office records
