“Investigation” means “to systematically examine, study, or inquire into; search or examine into the particulars of; examine in detail, or, to search out and examine the particulars of in an attempt to learn the facts about something hidden, unique, or complex, especially in an attempt to find a motive, cause, or to find things.”

According to section 2(h) of the Code of Criminal Procedure, “investigation” refers to “any proceedings under this Code for the collecting of evidence performed by a police officer or any person (other than a magistrate) who is authorised by a Magistrate in this capacity.” According to the Code, an investigation entails: 

1. Traveling to the scene of the crime. 

2. Gathering information about the case’s facts and circumstances. 

3. Locating and apprehending the alleged criminals. 

4. Gathering evidence, interrogating witnesses, including the accused, and writing down their statements 

 Searches for whereabouts or seizures of items that are deemed required.

Criminal investigation is an applied science that entails the examination of facts in order to identify, find, and prove a criminal’s guilt. Searching, interviews, interrogations, evidence collecting and preservation, and numerous kinds of investigation can all be part of a thorough criminal investigation. Many current scientific techniques, generally known as forensic science, are extensively used in modern criminal investigations.

WHAT IS FORENSIC INVESTIGATION?

It is a method and practise of presenting evidence and facts to a court of law. In today’s world, it is often employed in practically all investigations, such as those involving cybercrime or murder. The most common types of evidence employed include biological or DNA evidences such as hair or blood spotters, impression evidence such as fingerprints, and weapon identification such as microscopic inspection of tools that match the person’s wounds.

WHAT IS PROCEDURE AFTER INVESTIGATION?

Section 173 requires a police officer’s final report following the conclusion of an investigation to be forwarded to the Magistrate. This report is sometimes referred to as a “Chargesheet” or “Challan.”

If the police officer believes that a portion of the statement in his report is irrelevant, he must request that the Magistrate omit that portion and disregard it. Furthermore, further inquiry might be conducted even after the report has been submitted to the Magistrate.

CONCLUSION

In criminal law, an investigation is a very detailed process that is carried out in accordance with the law. But since the last 140 years, the police and criminal justice systems have remained unchanged. Police regard themselves as the rulers and protectors of the state, and there has been no change in their behaviour for a long time. In India, most bureaucrats participate in heinous actions that go unnoticed by police officers due to the habit of bribery and influence. The inquiry should be completed in a timely manner, without bias, and with the highest objectivity. Documentation of every step taken by the investigation team is beneficial in the event of a future inquiry and/or re-investigation.
