IPC SEC-90 (Consent known to be given under fear or misconception)
90.Consent known to be given under dread or misguided judgment.— An assent isn’t such an assent as it proposed by any part of this Code, if the assent is given by an individual under dread of injury, or under a misinterpretation of certainty, and if the individual doing the demonstration knows, or has motivation to accept, that the assent was given in result of such dread or confusion; or Consent of crazy individual.
If the assent is given by an individual who, from weakness of brain, or inebriation, can’t comprehend the nature and outcome of that to which he gives his assent; or Consent of youngster.—except if the opposite shows up from the unique circumstance, if the assent is given by an individual who is under twelve years old.
An Consent isn’t such an assent as is planned by any segment of this Code, if the assent is given by an individual under dread of injury, or under a misguided judgment of certainty, and if the individual doing the demonstration knows, or has motivation to accept, that the assent was given in result of such dread or misinterpretation; or
Consent of crazy person if the assent is given by an individual who, from shakiness of psyche, or inebriation, can’t comprehend the nature and outcome of that to which he gives his assent; or
Consent of youngster except if the opposite shows up from the unique circumstance, if the assent is given by an individual who is under twelve years old.
As per the sec-90 0f IPC, it clearly expresses that a consent shall be given to the accused only if he is insane or intoxicated during the commitment of the wrongful act or if any misconception occurs at that time of the wrongful act at that place.
