Islamic Law – Sunnah and Quran – Part 5

The word “Sunnah” is also used to refer to re

Naturally, once the Prophet was buried in his grave, and those Companions found themselves in the position of teachers-teaching others how to perform the prayer, how to pay zakat etc, they often mentioned what they had heard or seen from the Messenger of Allah. So their students put into practice the things that they learned from the Companions, and took note that it had come from the Prophet himself (SallAllah alayhi wasallam)

Shortly after that, once the Qur’an had been copied and re-copied enough times that there was no longer a risk of a catastrophe wiping it out from the Earth, the scholars began to also write down Hadith. In general, this began during the time of Imam Malik, who had only a single person between him and the Companions who witnessed those things (for example, Malik heard from Salim, who heard from his father Abdullah bin Umar, the famous Companion). So there was little need to suspect that much had changed in the interim.

Nonetheless, Imam Malik (and others of his era) set up procedures for authenticating Hadith and the narrators on the precision of their memories. This (as well as a lot of other evidence) led scholars to conclude that some narrations of Hadith are more reliable than others, and they decided to base their conclusions only on reliable Hadith.

As with other fields of study, like History or Literature, or Economics, or whatever, some bits of evidence are stronger than others. It is the work of a scholar to distinguish between the two. The Holy Koran has not explained every single thing that is needed for practising Islam, so we need to know what we need to do as a Muslim. And there is one more thing: if we do not authenticate the Koran too, because the Koran itself is the words of the Prophet that he has received from God through revelation.  There are several verses regarding prayers but the specifics lies with the the Prophet Muhammad in the way he enacted it. It was the Prophet that thought everyone how to pray after he was instructed by Jibril. This is one of many example of how the details of specific instruction in the Quran are made available in the Hadith.

Shari’ah, as it stands today, is the work of the jurisprudence that was developed over time. It is not found frequently in the Qur’anic or even the Hadiths. It is found in the commentary of various Hadiths and other Law Books of Fiqh (Jurisprudence )

Muslim Jurisprudence as it stands today, has various schools, and while they agree that their primary ‘sources’ are Qur’an and ‘Sunnah’, they do differ on the additional sources of Shari’ah, and there is plenty of those.

As for the word itself, in the Qur’an:

. The word Sha’ah as a noun , is mentioned only once (45:18) and even that as an indefinite noun (not Ash-Shar’ah or the Shar’ah)

. A related term “Shir’ah (is also mentioned just once (5:48)

. As a verb, it is mentioned twice, both in the same chapter (42:13 and 42:21)

In Hadith, the word Ash- Shari’ah (a definite noun form of Shariah) is only mentioned once, and that Hadith is considered weak (other than another Hadith considered:)

. Hadiths and Shari’ah are the practical versions of Qur’an. But they not different “message” books.

. Allah had given his messages to Prophet Mohammed in the form of Quran. But Mohammad showed the right way to implement Quran in real life to the Muslims in the form of Hadiths and Shariah.

. So, why we need those? For example, We all go to school and listen to our “teachers” even though we have “Text Books”. Similarly scientists can’t rely on theory books but they have to do practical’s in those theories too. Same is the way in the Hadiths and Shariah.

. Although some Muslims claim that some of the Hadiths information is “conflicted” or “misinterpreted” but still many Muslims have respect for those Hadiths.

. Because most of the scholars said “Quran” is compulsory (fard). Hadiths are highly recommended (Mustahabb).

In undertaking the job of interpreting God’s Law from the source texts, Muslim Jurists operated with an awareness of their own human fallibility.

The two fundamental sources of Islam are the Qur’an (the word of God) and the Sunnah (the example) of the Prophet (peace and blessings be upon him). By Sunnah, we mean the actions, sayings and silent permissions (or disapprovals) of the Prophet.

The word “Sunnah” is also used to refer to religious duties that are optional. Hadith is considered to be second to the Qur’an. It is impossible to understand the Qur’an without reference to the Hadith; and it is impossible to explain a Hadith without relating it to the Qur’an .

The Qur’an is the message, while the Hadith is the verbal translation of the message into pragmatic terms, such as exemplified by the Prophet. While the Qur’an is the message, while the Hadith is the Verbal Translation of the message into pragmatic terms, as exemplified by the Prophet . While the Qur’an is the metaphysical basis of the Sunnah, the Sunnah is the practical demonstration of the precepts laid down in the Qur’an .

The duty of the Messenger was not just to communicate the message, rather, he was entrusted with the most important task of explaining and illustrating that message. That is the reason why Allah Himself has commanded the following:

Say: Obey Allah and obey the Messenger, but if you turn away, he (the Prophet) is only responsible for the duty placed on him (ie to convey Allah’s Message) and you for that placed on you. If you obey him, you shall be on the right guidance. The Messenger’s duty is only to convey (the message) in a clear way. (An-Nur 24)

This verse clearly tellsus the overriding importance of Hadith to Muslims. They should be eager to learn and follow the teachings of the Prophet as expressed in Hadith. If we are negligent in this respect, it is we who have to answer before Allah.
