key goals for digital infrastructure

The key goals for this phase are as follows:

  1. Ensure the installation and access to relevant hardware: For Digital Courts to function properly, they are an unrelenting need for a continuous supply of power, stable internet connections, and other critical hardware to be installed properly to ensure the court’s uninterrupted functioning during proceedings.
  2. Creation of necessary Digital Infrastructure:
  3. Digital Case Registry – A unified digital case registry needs to be established to ensure ease of access and faster and efficient processing of cases related data. This phase seeks to ensure that every case has a CNR attached to it and that this method is adopted unvaryingly across India. Such an action would increase the visibility of cases, result in more efficient resource allocation, and enable the implementation of litigation risk assessment services.
  4. A comprehensive and updated repository of case laws –A freely accessible, updated, and comprehensive repository of all legal precedents would ensure the establishment of a consistent and reliable database, which in turn would increase the ease of access and use of standardized citations in the judiciary.
  5. Making various documents machine readable and secure – Such an effort would increase the ease of sharing data and the increased security measures would generate trust and increase the effectiveness of Digital Courts. Phase III aims to adopt modern technology which would allow us to achieve both aims.
  6. Intelligent Scheduling – AI based technology can be used to coordinate the availability and timetable of different users to recommend appropriate court proceeding schedules to increase the efficiencies of the system. Such a system would also diminish the number of adjournments and increase the working capacity of the judges and lawyers.
  7. Interoperable Criminal Justice System – There is an urgent need for continuous exchange of live data between the different branches of the criminal justice system in India, which would quicken processes, stop procedural lapses and guarantee that judicial orders are executed efficiently. Such an effort would also eliminate duplication of data and delays in the transmission of documents.
  8. Proper access to Critical Services: With respective to the infrastructure which has been defined above following the services which will be provided in the Phase III.
  9. Digital Case Management System: Moving the court files from one court to another consumes a lot of time and the environment cost which is incurred is very high. A case management system will be formed where everyone can access the files securely and will be of greater ease to search, track and index documents.
  10. E-filing: There will be process of e-filing and digital payment where the cases can be filed 24×7 from any part of the country. The same will be helpful in saving time and minimising error.
  11. Open Digital Hearings: The Digital hearing will help the lawyers and litigants to minimise the cost which is incurred in travelling. It will increase access to justice and decrease the various costs which are incurred.
  12. Transcriptions: Under Phase III the focus will also be to provide the transcriptions of the court proceedings. The lawyers can work on their case accordingly with these transcriptions and same can also be made available to someone who was not present during the time of the hearing.
  13. Service of Notice: A lot of delay and time is wasted in the process of Service of Notice. Thus, making the process through these digital technologies will help in a speedy delivery of notice.
  14. Remote digital assistance: In the Phase III a digital assistance will be created to facilitate remote assistance to litigants and various people in obtaining judicial information. The helpdesk will provide the copies of judgements and orders to the people who are not able to access online and cannot travel to the court.
  15. Administration of Legal Aid: Phase III is much equipped with an accurate case management system, open hearings, ICJS and digital transcription of proceedings that will assist the judges in-charge of legal aid authorities in more equitable and efficient allotment of cases to legal aid lawyers aided by data analysis.
  16. Virtual Courts: The Phase III is more focused on the proceedings which take up a lot of judicial time. Proceedings such as compounding of offences by payment of challans, small cause money claims and mutual consent divorce pleas will be shifted to online thereby reducing the burden on the courts.
