Law Commission of India

INTRODUCTION

The Law Commission of India is an administrative body which is established by the order of the Government of India, the main function of work for LCI is for legal reform and works as an advisory body to the Ministry of Law and Justice. The Commission submits reports to the government on various matters of a legal nature and its membership primarily comprises legal experts who are entrusted a mandate by the Government.

During the British Raj era in 1834 the first Law Commission was established by the Charter Act of 1833, and  was presided over by Lord Macaulay. In 1955 the first Law Commission in India was formed, its chairman being the then Attorney-General of India. The Law Commission members include the Chairperson and other members in the Commission. The ex-officio members are the Law Secretary and the Secretary (Legislative) under the Law Ministry.

The Functions of Law commission

The main function is to conduct legal research and review existing laws for making reforms in India. The other functions of the law commission are as follows:

  • Review/Repeal of obsolete laws: Identification of laws which are no longer relevant and that can be repealed immediately and identifying laws that require changes and to make recommendations as to the changes, and considering the suggestions given to the LCI by other ministries/departments regarding the revision or amendment of laws.
  • Law and Poverty: Examines the Laws which affect the poor and carries out necessary steps for socio-economic laws.
  • Recommend the enactment of new laws:  Suggesting the implementation  of new legislation as may be necessary to implement the Directive Principles and to attain the objectives set out in the Preamble of the Constitution.
  • Judicial Administration: Considering and conveying to the Government its views on any subject relating to law and judicial administration and also for improving the standards of administration of justice that may be specifically referred to by the Government through the Ministry of Law and Justice (Department of Legal Affairs).
  • Research: Considering the requests for providing research to any foreign countries as may be referred by the Government through the Ministry of Law & Justice.
  • Examining laws relating to gender equality and recommending change.
  • Examines the impact of unemployment, and recommends ways for the protection of the interest of the helpless.
  • Preparing reports on issues and on research undertaken and recommending the effective measures to be taken by the Union or State to the Central Government. 
  • Performs the task assigned to it by the Union Government.

Conclusion

The Law Commission of India (LCI) finds the laws which are not in accord with the existing time, and laws which require change. It suggests suitable measures for quick remedy of citizen’s grievances, in the field of law and takes all necessary steps to make the poor benefit out of the legal process. The presence of Law Commission of India has made a recent impact in time.
