Section 124A of the Indian Penal Code defines sedition as words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government established by law. Freedom of expression is one of the most integral rights we have, and anything that jeopardizes it needs to be approached with a lot of caution.
Every citizen has been guaranteed with the fundamental right of free speech and expression under Article 19(1)(a) that too is subject to reasonable restrictions under Article 19(2). Sedition is something when a person says or does something so as to incite public to act against government. Every person has the right to criticize any policy of government or speak freely regarding the same, but that doesn’t amount to sedition.
The right to dissent is the most crucial constitutional right. In a democracy, everyone has the right to agree or disagree. Concrete Criticism should always be welcomed and no one should fear in a democratic nation. Freedom of expression is one of the most integral rights we have, and anything that jeopardizes it needs to be approached with a lot of caution.
A democracy requires citizens to actively participate in debates and express their constructive criticisms of government policies. The weaponization of sedition has always been a trend, thanks to the third pillar of our constitution that is the judiciary which understands citizens rights and duties. Certainly the law of sedition in contemporary times is in conflict with the right of freedom of speech and expression, and therefore there is an urgent need to review the law of sedition.
The Law of Sedition was originally used by the British to maintain its dominance over India, and to suppress and punish the freedom fighters.
