WHO ARE LAWYERS?
Lawyers are the one who had degree e of pursuing law but had never represented themselves in courtroom on behalf of their client.
A lawyer can be future advocate, solitaire, attorney etc. They have very less experience as they have just been graduated from their Law School.
A lawyer can only give advice to their client but cannot represent them in the court room due to less knowledge. They have very less experience in legal matters.
DUTIES OF LAWYER
- They provide legal advice to the client.
- They do research and gather information or evidences.
- Lawyers can draw legal documents like contract, Wills, divorces etc.
- They provide clients with information regarding clients duty and their rights.
WHO ARE ADVOCATE?
According to Section 2(1) (a) – defines advocate as- an advocate entered in any roll under the provision, The Advocate Act 1961, which means that an advocate is a person who has their law degree and they can also represent their clients in the court room.
They have a charismatic personality with lots of legal knowledge. Advocates are experience in their work and are enrolled in Bar Council of India.
Advocates are the lawyer cannot engage themselves in a profession like business but can act as a sleeping partner in a firm or a business.
DUTIES OF ADVOCATE
- Advocates have a duty to protect the country.
- The hold integrity and Unity of nation.
- The educate the people to respect and follow the law, and also to respect the courts and judges.
- Advocates have good sense of humour and lots of patience. They represent argument in the court in very pleasing manner.
RIGHTS OF THE ADVOCATE
- Right to practice – Under Article (19) (1) (g) of The Indian Constitution and section 30 of The Advocates Act, the advocate has right to practice in the court of India.
- Right to fee – An Advocate have right to get their fee as per rule 11 chapter II of part VI of the Bar Council of Indian rules.
NEW ADVOCATES PROTECTION BILL 2021
On 2nd of July 2021, Bar council issued the Advocate protection bill 2021 for protection of the Advocates. For this 7 team was form to draw the law for advocates and his family as they face lots of challenges and difficulties.
The bill states that anyone who commits a wrongful act which means who threats assault, harm, etc aur which wrongfully impact the life of the Advocate or his family will be punished with 6 months to 5 years of imprisonment which makes tends to 10 years with penalties of rupees 50000 to Rupees 100000 and maximum of 10 lakh for repeated offences.
OWN VIEW
An advocate or lawyer both have legal knowledge and and also they have a law degree.
“Lawyer can be future advocate” and thus we can say that “all advocates are lawyer but all lawyers are not advocate”.
Advocate have a charismatic personality. They always work for the truth and Justice. They are hard work has always been appreciated by the society.
Lawyers at the person who does not have any experience of the court room, but they are working on themselves to be a future advocate, attorney etc.
Graduating from a law college is a first step in building up there future and working for the Welfare of the society.
