Legal Education in India

Law is important for a society as it serves as a norm of conduct for its citizens. Liberally, legal education serves the society by imparting law students general and culture education, making them good law abiding citizen, such legal education instills he significance and relevance of democratic culture in the students.

Law, legal education and development have became interrelated concept in modern developing societies, which are struggling to develop into social welfare state and seeking to ameliorate the socio economic  condition of the people by peaceful means. The same is true for our country. It is a crucial function of the legal education to produce lawyers with a social vision in a developing country.

As professional education, legal education equips law students for fulfilling different roles in society and discharging various law jobs. The range and scopes of which is always expanding in the modern democratic society, for example- policymakers, lawyers, law teacher, administrators, etc accordingly, it is realized in modern India that legal education ought.

Legal education in India had begun during the British period much before India gained its independence in 1947, law coursed were introduced at Hindu college in Calcutta and Elphinstone college in Bombay. the primary aim of legal education at the time was to equip law students so that they could help the lower courts and high courts in the administration of justice.

Basic knowledge of the law has before necessary for all those who are engaged in administration, trade or industry. A citizen to be effective in the enjoyment of his civic capacities needs basic knowledge of at least some aspects of law. Officials and others who perform important law roles. E.g. a policeman, businessman or politicians, need a understanding of parts of the law and its underlying policies and values.

In such a changing society with modernization at its peak, there is a need to improve legal education and expand it scope. There is a need to increase its ambit and for that, it is necessary, that legal education is not limited only to the study of law and legislation, but to the study of various procedures of law.

The objectives of legal education may be multi-fold in a developing democratic country like India. They are

  • To develop perceptions and to understand the problems of one’s society and to influence values and attitudes.
  • To generate different kinds of skills and knowledge needed for tasks in society.
  • To broaden opportunity and mobility in society-notably among groups who may have been deprived.
  • To develop research of valve to education and societies with use of educational facilities.

Conclusion

Legal education is a good investment which is wisely made will produce most beneficial result for the nation and catalyse the speed of development. The legal education provided at the law schools must be transformed to the conventional and contemporary needs of the legal profession and society.

Moot court competitions are one of the most enjoyable aspects of law school extracurricular activities. The concept of moot court competitions is straightforward: they are intended to simulate a court hearing. Through moot courts, the law school provides students with a taste of what it is like to be in a courtroom. Even though it is a requirement in the final year, most law schools hold inter and intramoot court competitions throughout the year to help students improve their mooting skills.  The student usually receives a factsheet, which provides a brief understanding of the dispute in question between two or more parties who are assigned to either the Plaintiff or Defendant’s side of the dispute. The fact sheet is usually provided to the students.   These teams are tasked with creating a fact sheet that includes two speakers and a couple of researchers, among other things. Within the time limit, the students must conduct research into their cases, develop arguments, and prepare responses to the dispute in the form of petitions and affidavits in opposition. Then, on the big day, the participants must defend their positions in front of a panel of judges, who will score them based on a variety of factors including their overall performance. It could be anything from researching to drafting to making an oral presentation.   Let us talk about how to prepare for moot court presentations in greater detail.  Understand the laws that apply to you.  As a law student, you must be familiar with the relevant statutes. You are not permitted to enter the moot court without having completed any prior research or preparation. As a result, you should always begin with the facts of your case. If you’ve been given any sample briefs, make sure to read them thoroughly.  The goal is to:   state the most persuasive arguments for your side;   clarify any points that were not made clear in the written material;   address any weaknesses in your case;   and be familiar with the counterarguments to your opponent’s arguments.  Recognize the relevant facts of the situation.  Each and every page of the case should be familiar and understandable to you. At all times during the debate, you should present yourself as the expert on the facts and be able to answer any questions from the panel.   Consider taking your time when framing your arguments.  Keep in mind that your arguments should be natural and organic in nature. Your oral submissions will be judged on how well you frame your arguments. It must be constructed with a great deal of patience and consideration.  …
