The Indian society is the society of customs and traditions. In Indian society marriage is considered to be Sacred. Marriage is regarded as a connection of soul to soul not for one life but for all. One thing which is seen as sin by many people is living of a couple as husband and wife without marriage that is also called as live-in-relationship. The Indian culture has changed so much from the ancient time. It has influenced from the western culture. In previous times, women are kept in home and were not allowed to work or study. But now situation has changed women are working in all fields and studying as much as they want.
With changing time, people’s thinking has also changed and they now do not mind an educated and working girl. Instead now if a girl is illiterate that is considered as bad now. But still this walk-in and walk-out relationship is not acceptable in society.
From Relationship now a day’s, people just want love and belongingness and consider their partners as equals. But when people find marriage is too binding for them and puts a lot of responsibility on them, they opt for live-in relationships. In marriages, you cannot separate easily there is a long process but in live-in relationship a couple can separate with consent when they feel that they are not going on well together. Of course marriage still is a very beautiful bond and those who are completely sure about their relationship and are capable of handling all responsibility go for marriages.
Article 19 of the constitution provides citizens rights to freedom of speech and expression and freedom to live wherever they want in India. Article 21 provides right to life and personal liberty to people. The given are the two constitutional basis on which Live-in-Relationships cannot be consider as offence. It provides that if two adult people are ready to live together, they cannot be restricted from doing so.
Allahabad High Court is setting example of saving people’s right to life and personal liberty. Sometimes before they have held ‘Right to select Partner is a Fundamental Rights’ and now court has held that “It is settled law that where a boy and a girl are major and are living with their free will, then, nobody including their parents, has authority to interfere,”
This high Court ruled this in the case of ‘Kamini Devi v. State of Uttar Pradesh’. In this case the petitioner is a girl who has filed this petition with her live-in boyfriend. Both petitioners fell in love one year ago. When the girl’s family came to know about it, they tried to marry her with an old man without even telling her about it. When the girl learned about it she left her home and forced to live with the 2nd petitioner. They are living together since 6 months. Now girl’s family is pressuring and forcing them to separate. Taking into consideration the facts of the case, Allahabad High Court rule that they are adults and cannot be restricted from living together with consents. And in case family not stopped, the Police commissioner is required to solve the matter and provide security to petitioners.
If two adult persons are living together, they should not be seen as sin. It is same as marriage and if the two people will feel that they are ready for responsibilities of marriage, they will marry. This act is not belittling sacrament of marriage rather it protects it. What’s the benefit of two people marry and not goes on well together and so filed for divorce within few months of marriage and now they are trapped in a long process of divorce. Marriage should be between two parties who know their partner and understand them and is all ready to spend their whole life together.
