Moot is a mock judicial proceeding that is set up to examine a hypothetical case as an academic exercise. Moot court is basically a replica of a real court where legal proceedings and mock trials take place. It is organized for a law student to take part and act as a professional lawyer and take up all the responsibilities and duties. The students participating in the moot court are required to analyze the moot problem, research for the relevant laws and prepare a memorial to present oral arguments at court. So basically, moot is designed to enhance the ability and skills of students to think like a lawyer.
A law student should do mooting because it consists of various kinds of skills which are essential for their all-round development. It helps students in building their career and for future growth and achievements. It not only enhances legal knowledge but also improves drafting skills, researching skills and communication skills. Every institute has a different approach towards mooting. In some institutes it is compulsory to take part in mooting whereas in some institutes mooting is a part of co-curricular activity. The procedure in moot court is similar to that of an actual court. Judges ask questions in order to identify the solution of cases in the most actual way. The speakers appear as an advocate to present their arguments.
In general, the mooting teams have to represent the arguments as an advocate on behalf of the petitioner side and on respondent side. There are two speakers on behalf of the appellant side and two speakers on behalf of the respondent side. Additionally, there is a researcher on both the sides who drafts the issues for their respective sides. So, the team totally comprises of three members 2 speakers and a researcher.
Timing is the key in mooting. Time management is very important in regards to mooting. Each speaker is permitted to address the court for a limited amount of time. The time limit varies with every round and every moot.
In the moot court competition, when pairs of teams seat together, then organizers call the teams for ‘Draw of Lots’ to decide the petitioner and the respondent. The teams then share a copy of their memorials to get familiar with the facts and arguments raised by the opposite team. Also, to find out any loopholes or mistakes that will help their team to gain advantage during the proceedings.
