The Motor Vehicles (Amendment) Act of 2019 was introduced in the House of Commons in July 2019 to amend the Motor Vehicles Act of 1988 and introduce new road safety traffic rules. In addition to more severe penalties for traffic violations, the law also established new rules related to permits and permits and vehicle health standards. Before passing the new Motor Vehicles (Amendment) Act of 2019 in September last year, Lok Sabha started the process with the Motor Vehicles (Amendment) Act in 2017. These amendments are intended to introduce changes in the transportation sector to promote safe driving practices for Indian motor vehicle drivers. The draft amendment has been submitted to the House of Commons, proposing severe fines for those who violate traffic regulations.

 After obtaining the approval of the People’s Chamber, the Federal Chamber proposed three amendments to the law. Lok Sabha will review these changes. The 2019 New Motor Vehicle Law has made major changes to existing traffic rules and penalties. On the other hand, the bill also provides citizens with medical assistance to prevent any accidents on the road. In addition, the amount of compensation in the event of death or injury has increased.

The changes that bring after the new motor vehicle act 2019 are-

•  According to the new Motor Vehicle Act of 2019, the fine for uninsured driving of a motor vehicle has been increased from 1,000 rupees and Driving under the influence of alcohol or intoxicating substances.
•  Driving under the influence of alcohol or substances is one of the biggest problems today. Of course, this is also a serious illegal act because it poses a great risk to the safety of drivers and other road users. Therefore, according to the new traffic rules and fines, the fines that violators should pay have increased several times. Compared with the old fine of 2,000 rupees, the first offender now has to pay 10,000 rupees and/or face 6 months in prison. In addition, the second offender must pay 15,000 rupees and may face up to 2 years in prison. Or up to 3 months imprisonment to 2,000 rupees and/or up to 3 months imprisonment. Up to 3 months’ imprisonment for the first offender and 4,000 rupees and/or the second offender.
• In case someone is not wearing the helmet then the traffic fine for riding a two-wheeled bicycle without wearing an ISI-approved helmet has been increased from 100 rupees to the current 1,000 rupees.
• In case of speeding another very serious infraction that we often see on our roads is speed testing and racing. For this reason, the fine for first-time offenders has been increased from Rs 500 to Rs 5,000 and / or up to 3 months in prison, while for repeat offenders it is Rs 10,000 and / or up to one year in prison.
• DL for unqualified driving – If nonqualified driver’s license is found, a fine of Rs 10,000 may be imposed. The previous fine was only 500 rupees.
• Someone is having two licences- if it is determined that a person has two or more driver’s licenses, they can be penalized. Furthermore, from now on, all issued driving licenses will have smart chips, which can be accessed by the traffic police using a QR code.

The introduction of the new 2019 Motor Vehicle Law clearly aims to ensure that motorists start to obey traffic rules more seriously, thereby promoting safe and sustainable traffic across the country. We hope that with the introduction of the amendment, people will be more careful when using vehicles. In addition, we expect a significant decline in drunk driving, not wearing seat belts, reckless driving, speeding and racing.
