Note on preamble


The Preamble is the one-paragraph introduction to the Constitution. A preamble is an introductory and expressionary statement in a document that explains the document’s purpose and underlying philosophy. When applied to the opening paragraphs of a statute, it may recite historical facts pertinent to the subject of the statute. It usually states the reasons for and intent of the law. It indicates as to what to follow. Through the words- sovereign, socialist, secular, democratic, and republic, the preamble declares the philosophy and objectives of the nation. The preamble sets the stage for the constitution. The preamble is an introduction to the highest law of the land it is not the law. It does not define government powers or individual rights.


The preamble plays a very important role in shaping the destiny of the country. The preamble gives a brief idea to the makers of the constitution so that the constituent assembly make plans and formulates the constitution. The preamble describes the nature of the state, the form of the government, the ideas of the nation and its people and the objectives to be achieved. It acts as an aid during the interpretation of Articles when language is found ambiguous.


The 42nd Amendment Act, 1976 was enacted by the Indian National Congress headed by Indira Gandhi during an emergency after the judgment of the Kesavanand Bharati case, states that it was accepted that the preamble is part of the Constitution. As a part of the Constitution, preamble can be amended under Article 368 of the Constitution, but the basic structure of the preamble cannot be amended.The 42nd Amendment also amended Preamble and changed the description of India from “sovereign democratic republic” to a “sovereign, socialist secular democratic republic”, and also changed the words “unity of the nation” to “unity and integrity of the nation”. This amendment brought about the most widespread changes to the Constitution in its history.


The words, “We, the people of India…” indicate the ultimate sovereignty of the people of India. Sovereignty means the independent authority of the State, not being under the control of any other State or external power.
sovereign, socialist, secular, democratic, republic in the Preamble suggests the nature of the state.


Justice, liberty, equality, fraternity reflects the objectives of the Constitution. It contains the philosophy on which the entire Constitution has been built. The Preamble secures to all citizens equality of States and opportunity. It also contains November 26, 1949 as the date of adoption of the Indian Constitution.
