Online Privacy

According to Black’s Law Dictionary “right to be let alone; the right of a person to be free from any unwarranted publicity; the right to live without any unwarranted interference by the public in matters with which the public is not necessarily concerned” 

Privacy is a very important right that all the citizens of a country deserve. The Right to Privacy is acknowledged by all governments across the world and is even protected legally. Any person aggrieved with regard to their Rights to Privacy can approach the Courts to get justice. 

Article 21 of the Constitution of India states that “No person shall be deprived of his life or personal liberty except according to procedure established by law”. After reading the Article 21, it has been interpreted that the term ‘life’ includes all those aspects of life which go to make a man’s life meaningful, complete and worth living. 

The strategy adopted by the Supreme Court with a view to expand the ambit of Art. 21 and to imply certain right there from, has been to interpret Art.21 along with international charters on Human Rights. The Court has implied the right of privacy from Art.21 by interpreting it in conformity with Art.12 of the Universal Declaration on Human Rights and Art.17 of the International Covenant on Civil and Political Rights, 1966. Both of these international documents provide for the right of privacy. 
The right to privacy suggests that it is completely the choice of an individual that which parts of his life he chooses to disclose to the society. Nobody has the right to interfere in someone’s life without his permission. Every individual has his private family and professional life and only he has the sole right to disclose it to others. 

Internet privacy refers to technologies, protocols, and concepts related to giving its users more privacy protection while they use the internet. Internet privacy takes many forms, including mandatory privacy statements on websites, data sharing controls, data transparency initiatives and more. 

Today technology has taken over the world, it helps us in almost every aspect of our lives. But technology has its flaws as well. It has now become possible with the help of technology to invade an individual’s privacy very easily and get access to personal data which can be used to all sorts of illegal activities.  

The main piece of legislation in India dealing with the world of cyberspace is the Information Technology Act, 2000 (hereinafter, IT Act, 2000) which lays down the penalties for various cyber-crimes and other offences concerning technology committed via digital or electronic media. This Act was not passed for the purpose of protecting individuals’ data but is in fact a generic legislation covering a broad range of technology related issues like digital signature, e–governance, cyber contraventions, cyber offences, confidentiality and privacy. The issue of online privacy has been summarily addressed in the IT Act, 2000 and further elaborated on in the Information Technology (Amendment Act, 2008) and the Data Privacy Rules, 2011 which safeguard personal and sensitive data. 

Governments can help by enacting strict laws in order to protect the privacy of its citizens, but it’s also the duty of citizens to be cautious from their end. One should be diligent about what the share online especially on social media platforms. Social media platforms are an easy place for miscreants to easily access personal data from various people. Such data can be used for manipulating election results, defaming a person or even spreading fake information. At the end of the day, it is up to us how we use the internet and its services to our advantage.
