Pardon means the formal act of liberating someone. Every country has the right of pardoning. The court doesn’t take any emotions or history into consideration it strictly follows the law for the adjudication. Pardoning power proves to be an aid for correcting judicial errors. In a nutshell it means to consider the case beyond the framework of the judiciary.
Article 72 of the Indian Constitution deals with the presidents powers to pardon. Article 72 of the Constitution empowers the President to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence.
Pardon: When the court absolves all the punishments of the accused. It means putting the offender in a position as if he didn’t commit any offence.
Commutation: It means to replace a less stricter punishment with the most stricter punishment. It exchanges the punishment but doesn’t absolve the offender from the offence.
Retrieves: It means suspension of death penalty for a certain period not permanently. It means temporary stay of proceedings.
Respites: Lesser punishment is given on some special grounds. It is awarded in only exceptional cases.
Remissions: It means reducing the punishment without changing the character of the punishment. It means not giving different punishment but making changes in the same punishment.
Article 161 gives pardoning powers to the governor. Governor of the state has the same powers as that of the president except in the case of pardoning death penalty.
