Introduction
Gone the days when our society gave preference to men. Men are known as bread earner and heads of the family. Women were not so much eligible at that time but now the situation has changed. Now they have the power to compete in the world. They have the power to balance all the things either it is related to the household or related to the workplace.
Harassment is a form of discrimination. It is unwanted physical or verbal behaviour that offends or humiliates any person.
The sexual Harassment of women at workplace Act 2013 is India’s first Law against prevention, prohibition and redressal of sexual harassment at the workplace. The POSH Law came into force because of one tragedy, Bhanwari Devi, who is a social worker in Rajasthan and was gang-raped in 1992 when she stopped child marriage in the village where she was working. Her case was taken by Vishakha, a women organization. By following the guidelines of Vishakha, Supreme Court has made the POSH Act 2013. Supreme Court of India stated that physical contact is not necessary or considering the Act of sexual harassment. This Act applies to the women working in the Private, Government, and informal sectors.
The important feature of this Act is to establish an Internal complaint Committee at every office of the organisation to handle the sexual harassment matter and where the employees are less ten, the Act provides for setting up a local committee in every District by the District Officer. The power of the Local committee is the same as civil court.
Workplace sexual harassment is a type of gender discrimination. Its effect and violet the fundamental right of women that article 14, 15, and 21 o Indian Constitution. Workplace sexual harassment affects the growth of women, It decreases the ability to do work with the competing society and also decreases their morale.
India first legislation addressing sexual harassment of women at the workplace made by the Ministry of women and child development, India in 2013. The Act is called Prevention, Prohibition and Redressal 2013. Criminal Law also amended in 2013. Some offences are also added to it such as stalking, sexual harassment, voyeurism.
The main Objective of the POSH Act is to Preventing women from Sexual Harassment in the Workplace and provide a proper procedure or redressal of complaints of sexual harassment and through this Act, a secure, safe environment is provided to the workplace.
