Professional ethics in law

Professional ethics circumscribes a moral cipher governing the conduct of persons included in the practice of law as well as persons involved in the legal zone. All the people of the legal profession have an important responsibility or obligation towards the court and towards the administration of justice. This duty succeeds over all other duties, especially in the situations where there may be a dispute of duties. It is important that lawyers conduct themselves with good mannerism, uprightness, provide proper assistance to the court, and envelope public confidence in the legal system. In carrying out their obligations, they are required and expected to deal with several members of the legal profession with courtesy and with good mannerism. Advocates are not only professionals but are also officers of the court and play a big role in providing administration of justice to the system.

Apparently, the set of rules that guards their professional conduct comes out of the obligations that they owe towards the court, their clients, their opponents and the other advocates. Rules that an advocate needs to maintain on the professional basis are mentioned in Chapter II, Part VI of the Bar Council of India Rules. These Rules have been provided under section 49(1)(c) of the Advocates Act, 1961.

Duties of an advocate towards the Court.
• Act in a noble manner
An advocate must behave in a noble and respectful manner during the time of his case as well as while acting before the court. He should demeanour himself with self-respect. Whenever there is a ground for complaint against a judicial officer, the advocate has a duty to give in his grievance to the concerned authorities.

• Respect the Court
The advocate must show his respect towards the Court. He or she has to keep in mind that the dignity and respect towards the judicial officer are necessary for the survival of a free group.

• There shouldn’t be any communication in private
The advocate should not communicate with the judicial officer in private regarding any case pending before the court. The advocate should not disobey the decision of a court in any matter through illegal or improper acts such as coercion, bribe, etc.

• They should refuse to represent the clients who insist them on any unfair means of practice
An advocate shall refuse to represent the client who urges on using illegal or dirty means. He shall be noble in using his language in resemblance and arguments before the court. He shall not scandalously defame the reputation of the parties on false grounds during the pleadings.


• They should appear in a proper dress code before the court
advocate should be present at all times in the court only in the proper dress code prescribed by the Bar Council of India Rules, and the dress code must be neat and tidy.


• He should not represent the foundation of which he is a member
An advocate should not appear before the court, for or against any foundation in which he is a member. But this rule doesn’t applies in the case of appointment as an ‘Amicus Curiae’ or without a fee on behalf of the Bar Council.

Tips for Moot Court Competition

Moot court competitions are one of the most enjoyable aspects of law school extracurricular activities. The concept of moot court competitions is straightforward: they are intended to simulate a court hearing. Through moot courts, the law school provides students with a taste of what it is like to be in a courtroom. Even though it is a requirement in the final year, most law schools hold inter and intramoot court competitions throughout the year to help students improve their mooting skills.  The student usually receives a factsheet, which provides a brief understanding of the dispute in question between two or more parties who are assigned to either the Plaintiff or Defendant’s side of the dispute. The fact sheet is usually provided to the students.   These teams are tasked with creating a fact sheet that includes two speakers and a couple of researchers, among other things. Within the time limit, the students must conduct research into their cases, develop arguments, and prepare responses to the dispute in the form of petitions and affidavits in opposition. Then, on the big day, the participants must defend their positions in front of a panel of judges, who will score them based on a variety of factors including their overall performance. It could be anything from researching to drafting to making an oral presentation.   Let us talk about how to prepare for moot court presentations in greater detail.  Understand the laws that apply to you.  As a law student, you must be familiar with the relevant statutes. You are not permitted to enter the moot court without having completed any prior research or preparation. As a result, you should always begin with the facts of your case. If you’ve been given any sample briefs, make sure to read them thoroughly.  The goal is to:   state the most persuasive arguments for your side;   clarify any points that were not made clear in the written material;   address any weaknesses in your case;   and be familiar with the counterarguments to your opponent’s arguments.  Recognize the relevant facts of the situation.  Each and every page of the case should be familiar and understandable to you. At all times during the debate, you should present yourself as the expert on the facts and be able to answer any questions from the panel.   Consider taking your time when framing your arguments.  Keep in mind that your arguments should be natural and organic in nature. Your oral submissions will be judged on how well you frame your arguments. It must be constructed with a great deal of patience and consideration.  …
